MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Carolie D. Owens and Peter R. Owens, Trustees of The <br /> Carolie D. Owens Trust <br /> 16 Spoondrift Circle (Map 111 Parcel 118) <br /> Mashpee, MA 02649 <br /> SP-2020-40 <br /> • The home is pre-existing, non-conforming and is not substantially more <br /> detrimental than the existing non-conforming structure or use to the <br /> neighborhood. <br /> • There is adequate land area to provide sufficient parking and setbacks as may <br /> be required. <br /> • Variance relief is not required due to the size and location of the lot, and the <br /> proposed new dwelling will comply with the current setbacks and lot coverage. <br /> • The floor plans were revised to accommodate the Board of Health requirements. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Special <br /> Permit. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> November 18, 2020, the Zoning Board of Appeals voted unanimously to issue a Special <br /> Permit to Peter R. and Carolie D. Owens to raze and replace a pre-existing non-conforming <br /> single family residential structure on property located in an R-3 Zoning District, at 16 <br /> Spoondrift Circle,Map 111 Parcel 118,Mashpee, MA. (Owner of Record: Trustees of The <br /> Carolie D. Owens Trust) with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2.
