The Board scheduled and duly and timely provided notice of the November 18, 2020 opening of <br /> the public hearing on the Petition ("Public Hearing") as required under MGL c.40B, §21 and MGL <br /> c.40A, §11; and the Board also duly posted each session of the Public Hearing. <br /> 5. On November 18, 2020,the Public Hearing timely opened (the opening was timely by operation <br /> of the provisions of St. 2020, c.53 and by an extension of the thirty day period to open the <br /> hearing provided by Petitioner); and the Public Hearing continued on January 13, 2021,January <br /> 27, 2021 and February 2, 2021. <br /> 6. On February 2, 2021,the Board voted 5-0 to close the Public Hearing and began the deliberative <br /> period. <br /> 7. The following Board Members were present for the public hearing sessions and deliberated on <br /> the Petition: <br /> Chairman Jonathan D. Furbush <br /> Vice Chairman William A. Blaisdell <br /> Member Scott Goldstein <br /> Member Norman J.Gould <br /> Associate Member George Ganzenmuller <br /> 8. During the Public Hearing,the Board received and took into consideration all of the comments <br /> and correspondence received from the Local Boards and from abutters and from the Petitioner. <br /> 9. On May 1, 2017,the Mashpee Town Meeting voted to transfer the Property(owned by the <br /> Town)to the Mashpee Affordable Housing Trust("MAHT")for purpose of developing affordable <br /> housing; and, thereafter, MAHT and the Petitioner entered into a development agreement to <br /> allow the Petitioner to file the instant Petition and develop the Property for affordable rental <br /> housing. <br /> 10. The PEL issued by DHCD contains all of the findings required under 760 CMR 56.04(4) and, as a <br /> result, the Petition satisfies all jurisdictional requirements and is eligible to apply for and receive <br /> a comprehensive permit. <br /> 11. As of the date of receipt of the Petition,the Town of Mashpee ("Town") had not achieved the <br /> 10%affordable housing threshold identified in MGL c.40B, §20 or any other"safe Harbor" under <br /> MGL c.40B or 760 CMR 56.00 and the Board found that the Town has a critical, unmet need for <br /> affordable rental housing. <br /> 12. The Petition satisfies all jurisdictional requirements to receive a comprehensive permit. <br /> 13. The Project, as set forth in the Plans and with the Waivers granted herein and the Conditions set <br /> forth herein, is Consistent with Local Needs as required under 760 CMR 56.05(4) and there are <br /> no Local Concerns created by the Project. <br /> B.
