resources that would occur if the spaces were placed on Parcel Band the on street parking <br /> spaces will improve public safety within the meaning of ZBL§174-37 by providing important <br /> parking for the Project and the Board notes that no special permit relief is required for this by <br /> operation of 760 CMR 56.05(7). <br /> 12. The Project complies with the requirements of the Massachusetts Fire Code, as confirmed by <br /> the Mashpee Fire Department. <br /> 13. The Project will be supplied with water by the Mashpee Water District and the necessary <br /> connection permit is hereby provided by this comprehensive permit. <br /> 14. The Project will be served by private sewer infrastructure that will be located on Parcel B and <br /> will conform to the requirements of the Board of Health; and the necessary sewer connection <br /> permit is hereby provided by this comprehensive permit. <br /> 15. The 39 rental units shall be affordable to households earning 80%or less of the Area Median <br /> Income as calculated by the Department of Housing and Urban Development or for a greater <br /> degree of affordability as may be required under the development agreement between the <br /> Petitioner and the MAHT or under any state or federal grant program used for the Project and <br /> with the units to be affordable for so long as: (1)the Project does not conform to local zoning <br /> requirements; (2) required under the development agreement between the Petitioner and <br /> MAHT; (3) required under any state or federal grant program used for the Project; and (4) <br /> required under any local Community Preservation Act grant restriction. <br /> C. GENERAL FINDINGS AND DELIBERATIONS: <br /> 1. The Project is consistent with the Town's Affordable Housing Plan and the direction given by the <br /> May 2017 Mashpee Town Meeting that the Property shall be developed for affordable housing <br /> purposes. <br /> 2. The Petitioner has considerable experience and expertise in developing and managing <br /> affordable housing. <br /> 3. The Project is appropriate for the Property. <br /> 4. With the Conditions imposed below,there are no Local Concerns and the Project is Consistent <br /> with Local Needs. <br /> D. CONDITIONS IMPOSED <br /> 1. The Petitioner shall adhere to the comments made by the Mashpee Board of Health on <br /> September 25, 2020 and November 18, 2020, copies of which are attached hereto as Exhibit A, <br /> regarding the wastewater infrastructure. <br /> 2. The Petitioner shall adhere to the comments made by the Mashpee Planning Board on <br /> November 4, 2020, a copy of which is attached hereto as Exhibit B; and the Petitioner: <br /> 4 <br />
