MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Petitioner, Eprem Epremian <br /> Owners of Record: Frederic W. Blythe and Melissa P. Phillips <br /> 228 Wading Place Road (Map 112 Parcel 59) <br /> Mashpee, MA 02649 <br /> SP-2021-05 <br /> Scott Goldstein commented as one member, that the applicant has complied and meets all <br /> the requirements of the bylaws, and the house was moved further away from the sideline. <br /> He doesn't believe that the A/C unit is a structure, and is no different than steps. <br /> Greg Siroonian with RESCOM commented that the A/C unit as depicted on the plan <br /> because it's in the AE flood zone, and will be out of the VE flood zone. The grading is <br /> above the requirements. The units will not be raised on any platform. <br /> Attorney Kirrane said that his client will provide a buffer with plantings to avoid any noise <br /> or potential views of the A/C unit. <br /> GENERAL CRITERIA: <br /> The subject property located at 228 Wading Place Road is approximately 25,000 square <br /> feet. <br /> Attorney, Brian Wall represented his client at 226 Wading Place Road who spoke in <br /> opposition of the new dwelling proposal. His client also spoke to the Board. <br /> There were no more comments from the Board. <br /> SPECIAL PERMIT CRITERIA: <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History: Added 10-15-2018 ATM, Article 16, approved by <br /> Attorney General 1-9-2019. <br /> No pre-existing,non-conforming single or two (2) family dwelling structures shall be torn <br /> down and rebuilt on any lot unless there is an issuance of a Special Permit from the Zoning <br /> Board of Appeals. Such a Special Permit may be granted only if the Zoning Board of <br /> Appeals finds that any changes,extensions,alterations or reconstruction of the pre-existing <br /> non-conformities are not substantially more detrimental than exists prior to removal of the <br /> existing structure and that there is adequate land area to provide sufficient parking. In no <br /> case shall new non-conformities be permitted without the issuance of a Variance. <br /> 4 <br />
