MASHPEE ZONING BOARD OF APPEALS <br />MEETING MINUTES <br />MARCH 10, 2021 <br /> <br />Attorney Kirrane commented that if the lot has protected lot status, the Building <br />Commissioner could make the determination as to whether or not there was need for any <br />relief from either the front yard or wetland setback. <br />the reason for the 15 ft. variance from the front yard, and the 50 ft. variance from the <br />wetlands. <br /> <br />The Building Commissioner said that the lot size is part of the protection status, as well as <br />the frontage. He does not know the setbacks in 1967, but he believes that the lot needs to <br /> <br /> <br />Attorney Kirrane is willing to withdraw the lot size and frontage request. <br /> <br />Mr. Blaisdell agrees with the Building Commissioner. Since the Board is unsure of the <br />setbacks and the wetlands setbacks in 1967. If the Board were willing to entertain approval <br /> whatever the distance <br />agrees with the Building Commissioner. <br /> <br />Mr. Reiffarth said even though this lot is protected, the Town considers this a non-buildable <br />lot today. <br /> <br />buildable or not. <br /> <br /> <br /> <br />Mr. Bonvie wanted to clarify the relief request from Attorney Kirrane if the Board makes <br />a motion to approve. The motion would be from the 50 ft. setback from the wetlands, and <br />a variance in the amount 15 ft. <br /> <br />Mr. Ganzenmuller read the Board of Health comments dated March 10, 2021 into the <br />record. He also read the Conservation Department comments into the record dated March <br />4, 2021. <br /> <br />Mr. Furbush read three abutter letters into the record, and wanted to know where the <br />parking would be. Attorney Kirrane said that a 25 ft. drive way will accommodate enough <br />parking for two vehicles. <br /> <br />The Board reviewed the site plan that depicted the location of a driveway, and that the <br />wetlands runs through the middle of the lot.
