Town of Mashpee <br /> N <br /> 16 Great JVeck P oad Jdorth <br /> A ily Maslipee,Alassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT/MODIFICATION <br /> SP-2021-3 3 <br /> Petitioner, JD Mercantile Properties, LLC Bk.: 30732 <br /> 53 Mercantile Way Pg.; 100 <br /> (Map 88 Parcel 86) <br /> Mashpee, MA 02649 <br /> A Petition was filed on April 1, 2021 by Petitioner, JD Mercantile Properties, LLC <br /> requesting a Special Permit/Modification under §174-24 C, §174-25 G(14), §174-75 D(1) <br /> of the Zoning Bylaws to allow for construction of a second commercial building of <br /> approximately 5,000 sq. ft. on site to be used as contractor bays consistent with the existing <br /> use of the site, on property located in the I-1 and Light Industrial Overlay District(s), at 53 <br /> Mercantile Way, Map 88 Parcel 86, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter <br /> 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on April 2, 2021 and April 9, 2021. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall as a virtual remote <br /> meeting on Wednesday, April 28,2021 at which time the following members of the Board <br /> of Appeals were present; Chairman, Jonathan Furbush,Vice Chairman, William Blaisdell, <br /> Board Members, Scott Goldstein, Norman J. Gould, and Associate Member, George <br /> Ganzenmuller. <br /> Attorney Kevin Kirrane, represented JD Mercantile Properties who is the current owner. <br /> Back in 2017, the Board approved a Special Permit for construction of a 7,440 sq. ft. <br /> industrial building. It was issued to Capewide Construction, Inc. who was the applicant at <br /> that particular time. The current request is to add a smaller building consisting of 4,920 sq. <br /> ft. on the rear of the site behind the existing building, and is consistent with the contractor <br /> bay use in the existing building. There will be four contractor bays in the four units. The <br /> additional square footage requires six additional parking spaces, bringing the total number <br /> to 15 spaces. The application under the bylaws include contractor bay office space. The <br /> Board must consider the findings under §174-23C (2) for consideration of health and <br /> safety. The additional building will be an expansion of additional uses. There are no <br /> wetlands on this approximate site. <br /> 1 <br />
