MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT/MODIFICATION <br /> Petitioner, JD Mercantile Properties, LLC <br /> 53 Mercantile Way, (Map 88 Parcel 86) <br /> Mashpee, MA 02649 <br /> SP-2021-3 3 <br /> Attorney Kirrane mentioned that Dan O'Jala with Down Cape Engineering did the <br /> engineering for the site,and Joao Junqueira is the contractor and owner of the site who will <br /> be constructing this building. The appropriate precautions have been taken to ensure that <br /> any surface water is addressed and retained on the site. The building will conform to all <br /> setbacks and parking requirements. The use is permitted with a grant of a Special Permit <br /> by the Board. <br /> Mr. Furbush wanted to know the total amount of contractor bays, and if this would require <br /> more handicapped spaces. He also asked what type of businesses will be occupying the <br /> contractor bays. Dan O'Jala said that only one space is required because there's no curbing <br /> and is a very level lot. If the building were to be open to the public,or had retail space then <br /> an extra parking space would be needed. <br /> Joao said that the bays will be used for storage, landscapers, or other contractors. He said <br /> that one of the bays will provide storage for a wood working contractor, and the others are <br /> for dry storage of furniture. <br /> Attorney Kirrane said that at one time the Town required a Special Permit for every <br /> business that went into any space in Mashpee, but that has changed over the years, as long <br /> as the business is consistent with the original uses that were authorized under the <br /> construction of the building. If the Board wanted to impose conditions relative to the <br /> storage of chemicals, the Board has the right to do that. <br /> The Board received a copy of the lighting plan. Dan said that there is not much lighting <br /> required. There will be some LED wall packs downward facing between the two buildings. <br /> If a vehicle is stored, a condition can be imposed that a floor drain be installed. The tank <br /> will be fully contained. <br /> Attorney Kirrane said that a permit from the Fire Department would be required for any <br /> storage of chemicals. <br /> Joao said that there are no plans for office use,just warehouses. <br /> The Board of Health comments dated April 27, 2021, and the Plan Review <br /> recommendations were read into the record. <br /> There were no more comments from the Board, and there were no abutter phone calls. <br /> 2 <br />
