MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT/MODIFICATION <br /> Petitioner, JD Mercantile Properties, LLC <br /> 53 Mercantile Way, (Map 88 Parcel 86) <br /> Mashpee, MA 02649 <br /> SP-2021-33 <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Special <br /> Permit.Upon motion duly made and seconded at the Public Hearings on Wednesday,April <br /> 28, 2021 the Zoning Board of Appeals voted unanimously to issue a Special <br /> Permit/Modification to Petitioner, JD Mercantile Properties, LLC under §174-24 C, §174- <br /> 25 G (14), §174-75 D (1) of the Zoning Bylaws to allow for construction of a second <br /> commercial building of approximately 5,000 sq. ft. on site to be used as contractor bays <br /> consistent with the existing use of the site, on property located in the 1-1 and Light <br /> Industrial Overlay District(s), at 53 Mercantile Way, Map 88 Parcel 86, Mashpee, MA, <br /> with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan: 53 Mercantile Way, Mashpee, MA, Prepared for: Capewide <br /> Construction, Scale: 1"=20', Sheet 1 of 2, Prepared by: Down Cape Engineering, <br /> Inc., Stamped by Dan Ojala, Professional Engineer and Land Surveyor, Dated <br /> 3/l/21. <br /> 3. Floor Plan: Project: Contractor Warehouse Building, 53 Mercantile Way,Mashpee, <br /> MA. Date issued: 02/26/2021, Dwg. Scale: '/4" = 1', Prepared by Capewide <br /> Construction, Sheet A-l: Ground Floor Plan, A-2: Northeast Elevation, Southeast <br /> Elevation,A-3: Southwest Elevation and Northwest Elevation. <br /> 4. Conditioned on all Town Department comments read into the record including but <br /> not limited to the Plan Review comments; <br /> • Floor drains be installed for the industrial waste water holding tank for any bays <br /> where vehicles are kept and stored inside the new second building. <br /> • That the back fill base material and pavement be consistent with the already <br /> established area and recommendation of the former consulting engineer from the <br /> original approved Special Permit. <br /> • If the applicant plans to expand the septic tank beyond the 360 gallon flow per <br /> day for 24 employees per day, will require Board of Health approval. A septic <br /> inspection will be required for the increase in flow. <br /> • Addressing of the new building be approved by Clay Nicholson, GIS <br /> Coordinator. <br /> 5. Conditioned that Charlie Rowley or his replacement approve the plan at the owner's <br /> expense. <br /> 3 <br />
