MASHPEE ZONING BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT/MODIFICATION Petitioner, JD Mercantile Properties, LLC 53 Mercantile Way, (Map 88 Parcel 86) Mashpee, MA 02649 SP-2021-33 In view of the foregoing, the Board determined the Petitioner met the criteria for a Special Permit.Upon motion duly made and seconded at the Public Hearings on Wednesday,April 28, 2021 the Zoning Board of Appeals voted unanimously to issue a Special Permit/Modification to Petitioner, JD Mercantile Properties, LLC under §174-24 C, §174- 25 G (14), §174-75 D (1) of the Zoning Bylaws to allow for construction of a second commercial building of approximately 5,000 sq. ft. on site to be used as contractor bays consistent with the existing use of the site, on property located in the 1-1 and Light Industrial Overlay District(s), at 53 Mercantile Way, Map 88 Parcel 86, Mashpee, MA, with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Special Permit under Mass General Law 40A Section 9. 2. Site Plan: 53 Mercantile Way, Mashpee, MA, Prepared for: Capewide Construction, Scale: 1"=20', Sheet 1 of 2, Prepared by: Down Cape Engineering, Inc., Stamped by Dan Ojala, Professional Engineer and Land Surveyor, Dated 3/l/21. 3. Floor Plan: Project: Contractor Warehouse Building, 53 Mercantile Way,Mashpee, MA. Date issued: 02/26/2021, Dwg. Scale: '/4" = 1', Prepared by Capewide Construction, Sheet A-l: Ground Floor Plan, A-2: Northeast Elevation, Southeast Elevation,A-3: Southwest Elevation and Northwest Elevation. 4. Conditioned on all Town Department comments read into the record including but not limited to the Plan Review comments; • Floor drains be installed for the industrial waste water holding tank for any bays where vehicles are kept and stored inside the new second building. • That the back fill base material and pavement be consistent with the already established area and recommendation of the former consulting engineer from the original approved Special Permit. • If the applicant plans to expand the septic tank beyond the 360 gallon flow per day for 24 employees per day, will require Board of Health approval. A septic inspection will be required for the increase in flow. • Addressing of the new building be approved by Clay Nicholson, GIS Coordinator. 5. Conditioned that Charlie Rowley or his replacement approve the plan at the owner's expense. 3
