SHELLFISH COMMISSION <br />MEETING MINUTES <br />October 12, 202114, 2021- 7:00 P.M. <br />MASHPEE TOWN HALL-16 Great Neck Road North <br />WAQUOIT MEETING ROOM <br />PRESENT: Buddy Pocknett, Bill Holmes, Darryl Christensen, Peter Thomas, Donovan McElligatt, Dick <br />Cook <br />PUBLIC: Matt Haney, Jaime Pachico <br />CALL MEETING TO ORDER Chairman Thomas called the meeting to order at 7:00pm. <br />PUBLIC COMMENT Matt Haney stated his concerns about scallops this year. He also pointed out that <br />the boat excise tax hasn't changed since 1978. The Commission thanked him for his comments and <br />agreed that it is a frustrating situation that involves a lot of things they can't control. As far as the excise <br />tax, that is out of their purview, but perhaps someone higher up and take a look at that. <br />MINUTES <br />Approval of the following: September 14, 2021-tabled until next meeting <br />COMMUNICATIONS AND CORRESPONDENCE <br />OLD BUSINESS <br />1. Water Quality in our Bays and Rivers — Task Force Update <br />Mr. Thomas said things are still in motion, but the meeting is deferred until the end of the year. <br />NEW BUSINESS <br />1. Shellfish Mitigation: Fee assessment for 43 Little Neck Lane <br />Mr. McElligatt said they cleaned up some of the wording in the Conservation Bylaw. It's a monetary <br />mitigation fee for any water dependent structure. There's a calculation for an objective fee to put money <br />into the Shellfish Fund. <br />43 Little Neck Lane was a dock reconstruction where planting in the buffer zone wasn't appropriate. It <br />passed though Conservation, so the fee will go into the fund. We're still figuring out when the fee will be <br />collected. Right now it's an Order of Conditions, so they'd pay at the end of the project, but before they <br />receive the Certificate of Completion. We're looking at different avenues of assessing the fee, like taking <br />the fiscal year into inconsideration. <br />Dennis uses the term shading for the footprint of the area. We don't want to ignore the footprint, but <br />"shading" isn't the right term. We need to quantify the amount of space a project takes up. How do we <br />quantify a water dependent structure? Mr. Cook said we should use the area under the structure itself. <br />Mr. McElligatt agreed, we can't just do pilings, under the structure has significant impact. Mr. Pocknett <br />said square footage of the whole footprint, even 3ft out is usually ruined. Mr. Thomas said the term <br />should be very definitive, we can talk more about this next month. <br />
