the pond. Joe Onorato said if this is approved tonight, they plan to do the surveys within
the ten day waiting period.
Rob Garf asked what will be done to mitigate this happening again. Agent said the goal is
to eradicate this by whatever means necessary. Public outreach and communication is key
to that, along with signage at the ponds.
Rob Garf asked about getting equipment at the ramp, Agent said that it's State run,we
would need authorization, making changes would start with concerned citizens contacting
the State.
Jack Mates from 53 Hoophole Road, made public comment thanking the Conservation
Department forjumping on eradicating this so quickly, and he encourages the approval of
this plan.
Ms. Zollo asked if we could contact the John's Ponds homeowners association about
signage. She also suggested we be proactive with getting signage at all ramps in Town.
Assistant Agent asked if this infestation is prevalent in other parts of the Cape, Joe
0norato said yes, nothing specific off the top of his head, but it's all over the place on
Cape.
Mr.Sweet motioned to close and issue with the conditions from Natural Heritage
and Native Species.
Mr.Dalton seconded the motion.
Vote: 5-0-0
Roll Call Vote:
Ms.Zollo; yes
Mr.Colombo; yes
Mr.Sweet; yes
Mr.Dalton; yes
Mr.Smith; yes
In favor,5; Opposed, 0; Abstentions, 0
6:03 36 Summersea LLC,36 Summersea Road. Proposed demolition and reconstruction of NOI
single-family homewith associated landscaping and hardscaping modifications, septic
system upgrade, and mitigation plantings. Representative: Sweetser Engineering.
Continued from 8126, 919 for submittal of landscape plan
Joe Anastos, the homeowner, presented plans.
Agent said all the missing details from the previous hearing have been provided in this
updated plan. The mitigation has a good mix of species. Meets performance standards.
The last comment is that we noticed a total of 9 trees cut, which resulted in an enforcement
order. It's a significant level of violation. Property owner said he was unaware of any
cutting, however, based on our experience, the cuttings appear to have been done within
the last year and the current owner is responsible. If this is approved, we recommend a
condition of requiring substantial compliance with the enforcement order in order for any
commencement of work to proceed, including demolition of existing home and construction
of a new home. At a minimum,a mitigation plan should be presented and approved by the
Commission. This violation needs to be dealt with sooner rather than later. The
homeowner has engaged with a wetlands consultant. Recommends a close and issue with
the condition mentioned.
Joe Anastos commented that he did not clear those trees and finds it disgusting that it was
done. He purchased the property at the end of May,and has pictures on his phone that he
took in June. He sold the property and needs to have the house completely done by
December of 2022. "1 told the Agent I did not remove the trees, but was told as the
homeowner I am responsible. I don't think it's fair that I can't start the project until
restoration is done. The new owner shouldn't be saddled with the 3 year monitoring
