situation. If I can't start this project I am going to take a serious financial hit for something I <br /> did not do. I'm willing to pay the costs for mitigation restoration and believe it's fair to be <br /> inspected at the conclusion of the project, but I'm asking to be allowed to continue the <br /> project and monitor after the first year the completion of the project ends. I respectfully ask <br /> that be considered." Agent clarified that he asked no more monitoring is required after he <br /> completes the project. Joe Anastos said "It's not fairto the new people moving in as long <br /> as he meets the requirements, please do the inspection at the end of the project. I'll do <br /> whatever you want me to do and absorb the costs."Assistant Agent said that typically the <br /> mitigation proposed with the house construction comes with a 3 year monitoring and <br /> maintenance plan. Agent said the mitigation that is forthcoming with the violation could be <br /> locked in to the mitigation you proposed with the project. "My recommendation is based on <br /> the scope of the violation. I don't endorse a 1 year monitoring and maintenance period. I <br /> recommend 3 years." <br /> Mr.Colombo asked what length of time before we see the mitigation plan, Joe Anastos <br /> said he doesn't really know, but he's already been in contact with the wetlands consultant. <br /> Mr.Colombo said he's not comfortable issuing an OOC unless I'm sure the mitigation plan <br /> is sufficient and in operation. Joe Anastos said he understands, that's why he hired the <br /> best people he could find. <br /> Ms. Zolla asked about vista pruning. Agent said it's not part of this application, should be <br /> disregarded. <br /> Agent said the purpose of the enforcement order was to separate the violation from the <br /> project. He recommends close and issue with conditions, he does not see a risk of non- <br /> compliance. <br /> Mr.Sweet motioned to close and issue with the condition we get a mitigation plan <br /> prior to any work being done. <br /> Mr.Dalton seconded the motion. <br /> Vote: 5-0-0 <br /> Roll Call Vote: <br /> Ms. Zollo; yes <br /> Mr.Colombo; yes <br /> Mr.Sweet; yes <br /> Mr. Dalton; yes <br /> Mr.Smith; yes <br /> In favor,5; Opposed, 0; Abstentions, 0 <br />
