They're using this now in shallower water, this is an improvement. <br /> Ms. Zollo said the property line is typically straight out, on this the line changes to fit this <br /> dock,which is not consistent with other plans. Matt Costa said these are not property lines. <br /> Property lines stop at mean low water, everything below that is the Commonwealth's land. <br /> There are 2 methods to use for property lines, whether it's straight or curved shorelines. It's <br /> a policy, not a requirement, that Chapter 91 likes to keep docks 25ft or more from projected <br /> property lines for navigation purposes. If you can't meet that 25ft offset,they typically ask <br /> for letter from abutters. Ms. Zollo said this looks like they'd be approving something in front <br /> of a neighbor's property without the neighbor's approval. Agent said that's Chapter 91 <br /> jurisdiction, it's not the purview of this Commission. <br /> Ms. Zollo said it feels weird to say the way it's currently being used is not great for the <br /> resource area, so this is improving it. The homeowner isn't entitled to use this the way he's <br /> currently using it. He could get a mooring. We're protecting the resource area and the <br /> depth just isn't there. Mr. Smith asked if the boat were on the dock and we observed <br /> grounding of any kind, would they be subject to an enforcement order?
