i <br /> 1 <br /> ■ <br /> Article <br /> To see if the Town will vote, notwithstanding any provision -of the <br /> Town By-Laws to the contrary, accept the layouts of DeerfieldRoad, <br /> Alden Circlet and Blair Circle as shown on a plan entitled "Layout of <br /> Deerfield Road, Mashpee, MA, Scale : 111=4 ' March 20, 1986,, Charles L. <br /> Rowley & Associates, Civil Engineers a Surveyors, West Wareham, MA" <br /> copy of which is on file 'in the office of the Town Clerk, and to <br /> authorize and empower the Board of Selectmen to- acquire the fee <br /> ownership or an easement in, on, over and under the said roads as so <br /> defined, by -deed or by eminent domain# and to accomplish said purpose <br /> and for expenses incidental and related thereto, the Town vote to <br /> appropriate $50FOOO and to raise such appropriation, the Treasurer, <br /> with the approval of the Board of Selectmen, be authorized o borrow <br /> at one time or- from time to time, $ coo under and pursuant to <br /> Chapter 44, Section 7 of Massachusetts General Laws, or any other <br /> enabling authority, and to issue bonds or notes of the Town therefore; <br /> and further that the Board of Selectmen assess betterments to the <br /> owners of the land abutting the ways and to an.y other owners of land <br /> deemed to the benfitted thereby, <br /> f <br /> Motion to appropri*ate , and to o ow * *unanimous vote* . 08: 1 <br /> Subject to betterments <br /> The Finance Committee approves this Article because there is no cost <br /> to the Town to reconstruct this road, The cost will be borne by <br /> betterment to those lot owners with frontage on Deerfield Road. It <br /> should be recognized that the existing road was. accepted by the Town <br /> of mashpee ' s Planning Board as being satisfactory and meeting cage <br /> specifications which, in fact, was not true. It is the feeling of the <br /> Finance Committee that when the road was built, it was substandard and <br /> should not have been approved, <br /> Residents of the Deerfield Road neighborhood have expressed to Select- <br /> men for several years their extreme concern over the drainage problems <br /> at the lower end of Deerfield Road, At the December 15 Special Town <br /> Meeting, townspeople approved a private petition article that was <br /> designed to accept Deerfield Road as a Town-owned way. This article <br /> was found by Town 'Counsel to be defective, As presently designed b <br /> Selectmen, the three roads in the subdivision would be accepted, funds <br /> would be borrowed to pay for repairs and betterments would be assessed <br /> o each lot owner to pay allcosts of the repairs . This process was <br /> recommended in the FY88 Capital Improvement Program. <br /> Article <br /> To see if the Town will vote, notwithstanding any provision of the <br /> TownBy-Laws to the contrary, to accept the layout and definition of <br />
