4 <br /> M <br /> .4.2.2 Within any calendar month, building permits for new dwelling <br /> units may be issued for not more than ten 10 percent of the <br /> number of new dwelling units allowed during that year under <br /> Subsection .4.2.1 . Within said limit, the actual number of <br /> permits issued shall be at the discretion of terBuilding a ♦_ .Y_r..,._.a.- __• y rr' r <br /> Inspector provided the annual 116mit specified by Subsection <br /> 6.4.2.1 is not exceeded. <br /> 6.4.3 Exemptions <br /> 6.4.3.1 The provisions of Subsections 5.4.1 and 6,4.2 shall not apply <br /> to Open Space Incentive Developments approved under Section <br /> g. , to developments previously approved under an unexpired <br /> special permit which included a specific annual phasing <br /> schedule, to public housing developed by the Mashpee Housing <br /> Aut hor:+y, to I cw or moderate income housing units as ,defl n d <br /> by the Massachusetts Departrent of Community Affairs. The <br /> provisions of Subsection E. .1 and 6.4.2 shall also <br /> not apply to lots in subdivisions protected temporarily from <br /> the provisions of this section by Massachusetts General Laws <br /> Chapter 40A Section 6, except that building permits for lots <br /> in said subdivisions shall be counted tad 'the annual total <br /> building permit limits of Subsection .4*2.1 . <br /> 5.4. ,2 The provisions of Section 6,4 shall not apply to non- <br /> residential structures, accessory structures, or alterations <br /> r additions which do not create a new dwelling unit. <br /> .4.4 Administration <br /> *4.4# 1 The Building Inspector shall compile and keep up-to-date <br /> listing of all subdivisions, special permit projects and <br /> other lands which are exempt or protected temporarily from the <br /> provisions of Section 6,4 either under Subsection 6,4,3 or <br /> under any applicable provisions of Massachusetts General Laws <br /> and the date on which any temporary protection will expire. <br /> o4.4.2 The Building Inspector shall determine prior to January 15 of <br /> any calendar year the number of existing dwelling units in the <br /> Town on, plus any deicing units for which building permits <br /> were issued by, December 31 of the previous year which have not <br /> expired. on the basis of that information and the pro isiores <br /> of Subsection . .2. 1 he shall determine the number of dwelling <br /> units not exempted by Subsection 6.4.3. 1 which may be issued <br /> permits during said calendar year. <br /> 6.4.4.3 Applications for building permits for new dwelling units may be <br /> filed only during the first fifteen 1 S days of any .month. <br /> However, no such permits will be approved until after the <br /> fifteenth day of the month to allow proper review and deter- <br /> mination of the order, of priority in which- they mar ' e issued. <br /> -19_ <br />
