Permits which are exempted by Subsection 6.4.3 or temporarily <br /> protected by Massachusetts General Laws from the provisions of <br /> this section may be applied for or issued at any time. <br /> .4.4.4 In issuing building permits, the Building Inspector shall first <br /> determine that the application and proposed structure conforms <br /> ms <br /> with the rules and regulations of the Board of Health, with any <br /> applicable building codes and with this ZoningBy-Law, includ- <br /> ing the provisions of Subsections .4.1 , For those applications <br /> which are in conformance and may otherwise be issued, building <br /> permits shall be issued, within the monthly limit, in the <br /> following order of priority <br /> First - Provided that the annual limit has not been exceeded, <br /> in the order of their receipt b the Building <br /> , <br /> Ins ec1 <br /> tor applications for individual single-family }4 <br /> p <br /> A ' I s k tie 1 eg+�1 ^ n nnu I t nn an ar <br /> of the previous year who has not received a pemit for <br /> a new residence in Mashpee during the previous 24 <br /> months and who has documented in writing to the Build- <br /> ing inspector his intention to reside on the premises <br /> for at least one year. <br /> Second- Provided that the monthly and annual limits <br /> have not been exceeded, permits for any dwelling units <br /> for which permits were applied ire previous months <br /> but were not approved based on the provisions of <br /> Section 6,4 may be approved, in the order of their <br /> receipt by the Building Inspector, up to the monthly <br /> and annual limits, except that among such applications, <br /> structures not located within a Primary or Secondary <br /> Conservation Area shown on the most recently adopted <br /> Open Space Incentive Plan shall be approved first, then <br /> any others may be approved. <br /> Th i rd if after perm its have been issued to all applicants <br /> in the first and second categories the monthly <br /> and annual limits have not been reached, building <br /> permits may be issued to other applicants up to <br /> the limits, in the order of their receipt by the <br /> Building inspector, except that structures not <br /> located within a Primary or Secondary Conservation <br /> Area shown on the most recently adopted Open Space <br /> Incentive Plab shall be approved first, then any <br /> others may be approved. <br /> 6.4-4.5 An application shall be considered received by the Building <br /> Inspector only if it is complete in all aspects, conforms with <br /> all applicable building codes and this Zoning By-Law, and has <br /> received all necessary approvals from the Board of Health, <br /> and, where necessary, the Board of Appeals and/or Conservation <br /> � - ± <br />
