Upon receipt of any application, it shall b
marked with the date and time of receipt.
6,4,4.,6 if in any month building permits for fever dwelling units are
issued than are allowed by the limits of Subsection .4. .2;
the difference between the limit and the actual number of
dwelling units for which permits were issued may be added to
the limit for the following month, -except at the end of the
. calendar year.
6.4-4.7 Where a building permit is to expire, no more than one 1
six-month extension may be granted by the Building Inspector
before an applicant shall be required to file for a new permit
following the rules and procedures of Section 6A and other
applicable laws and regulations.
3 for 1 against 1 abstain. . * * of o carries YES 12 . . .No . 0001. : i'
This article proposes a two-level control on residential growth rates In
order to reduce fiscal , traffic, social and env i ronfi, enta l impacts of the
Torn's current excessive rate of growth, The first level of control
would require that no more than 20 of the lots in any subdivision or
special permit residential development could be developed in any year
and that a specific phasing plan, conforming to that limit, be submitted
for all future subdivisions and residential special permits. In order
to protect lot buyers, the earliest date on which development may occur
under* the phasing plan is to be referenced in property deeds. Section
.4.2 provides for the second, level of control , which would be a limit
with a number of exemptions) on the total number of residential
building permits which could be issued in any year. The limit is set at
relatively high level in the first few years in order to avoid any
sudden adverse impact on the local construction industry and is then
gradually reduced to 2 1 2 percent per ,year, which is consistent with
the statutory fiscal constraints imposed on the Town' s ability to
provide serviceS to new development. There is also a monthly limit
specified in order to avoid an annual January overload of the Building
Inspector' s office. Section 6.4,3 specifies a number of exemptions from
the building permit limits in order to encourage OSID developments,
recognize existing special permit phasing schedules approved by the
Planning Board, and allow for public housing and other affordable
housing, State statutes also exempt lots in subdivisions from a l l
zoning changes , including this article, for eight years from the date
that they are signed by the Planning Board. This article recognizes
that fact but includes such permits within the annual limits. The
effect would be that building permits could be issued for such exempted
subdivisions, and any other units exempted by Section .4. , but that
other permits could not be issued after the annual limit is reached.
sect i-on 6.4.4 specifies how this a rt i c l e is to be administered by the
• Building Inspector,, including a specific order of preference for
non-exempt permits which provides that individual lot. owners intending
to reside in the proposed home will receive first preference, permits.
previously denied because of the limits will receive second preference,
and any others would be third.
