Gonsalves Jr.—Requests a Special Permit under Section 174-20 of the Zoning <br /> � <br /> p g <br /> By-laws,for permission to demolish an existing house and construct a single-family home <br /> on property located in an R-3 zoning district at 68 Seconsett Island Road(Map 119 <br /> Block 90),Mashpee,MA. (Owner of record:Manuel J. Gonsalves,Jr. and Anthony W. <br /> Gonsalves.) VA <br /> Members sitting: Edward M. Govoni, James E. Regan III and Robert G.Nelson. '; <br /> Mr. John Slavinsky of Cape&Islands Engineering represented the applicant and stated <br /> F that the existing dwelling is c � <br /> g g currently 19 feet from Seconsett Island Road and 25 feet <br /> _z � <br /> from Riverside Road. The structure will be 21 feet from Seconsett Island proposed and Road <br /> and <br /> .c <br /> Y 26 feet from Riverside Road. The applicant proposes to replace the existing cesspool <br /> pp p p p g p � <br /> s with the installation of a new Title V septic system. The Conservation Commission has � <br /> reviewed the proposal since the dwelling lies within 100 feet of. <br /> flood zone. Mr.f1�. <br /> Slavinsky informed the Board that the applicant plans to construct a four-bedroom cape- <br /> style home which will be compatible with the neighborhood. It will be constructed in f, <br /> almost the same area as the existing home,with a slight improvement on the setback <br /> requirements. <br /> No comments were received from abutters. <br /> _s <br /> Mr•Regan moved to ant the Variance of four feet on the northeast side and nines i <br /> =� g � feet off <br /> a of Seconsett Island Road subject to criteria 3 4 findings 2 and the fact that it will be ,. <br /> upgraded to a Title V septic system. Mr. Govoni seconded. All agreed. ,,1 . <br /> r <br /> Mr.Regan moved to grant the Special Permit, subject to findings 3,4,5,6. Mr. Nelson <br /> seconded. All agreed. <br /> }i <br /> Mr. Govoni stated that applicants are running into a problem when filing for ier,ram <br /> p g p � p <br /> and float with the Board of Appeals. Amer being granted a Variance and/or Special , <br /> Permit,the State is taking up to two years to grant permission for the construction of a <br /> Chapter 91 dock. He proposed that in the case of a Special Permit,when a license is ,�" • <br /> K applied for, it will trigger a Special Permit or Variance. Mr. Govoni suggested that the <br /> applicant notify the Board with a co of the application for the license. The Board will �:! • ' <br /> pp fY copy pp <br /> condition that the project has to be completed within one year after receiving the license. ` <br /> This will prevent applicants from having to appear before the Board of Appeals a second <br /> time because their Special Permit has expired. <br /> . <br /> p p , <br /> Mr.Nelson and Mr. Guerrera questioned if some applicants might apply for a license and <br /> ,.4,yy <br /> r not do any construction, Mr. Govoni questioned Mr. Slavinsky how the process works. <br /> Mr. Slavinsky said that applicants must apply to the State and the Planning Board.
