Board Members present were Vice Chairman #,' <br /> James E.Regan III, Board Member Robert G.Nelson and Associate Members Richard T. <br /> Guerrera and James M. Dorgan. Building Commissioner William F. Hauck and Local <br /> g g , <br /> Inspector Russell W. wheeler were in attendance. <br /> A* <br /> Cape Cod Ventures, Inc.-!iffy Lube--Requests a Variance from Section 174-31 and <br /> Section 174-40 of the Zoning By--laws for permission to vary the lot frontage and I <br /> accessway requirements on property located in a C-2 zoning district at 60 Falmouth <br /> Road(Map 55 Block 9)Mashpee,M.A. (Owner of record: MAC Realty Trust). <br /> Cape Cod Ventures, Inc. —Jiffy Lube—Requests a Special Permit under Sections 174-17, ►; r �� <br /> 174-209 174-25.F.3.5 174-25.H.6., 174-51.B.s 174-55.B. and 174-55.C. of the Zoning <br /> By-laws for permission to demolish an existing structure and to construct a Jiffy Lube r` " <br /> service station and signage on property located in a C-2 zoning district at 60 Falmouth <br /> Road(Map 55 Block 9)Mashpee,M.A. (Owner of record: MAC Realty Trust). <br /> y r'II <br /> Members sitting: James E. Regan III,Robert G.Nelson and James M.Dorgan. {�'' � <br /> Mr. Regan stated that this hearing is a Chapter 112 hearing and an determination made ` t=' <br /> p g Y 34.. <br /> by the Board will be subject to payment of taxes on the subject property. <br /> Attorney Kevin Kirrane represented the applicant, Cape Cod Ventures,Inc., and <br /> reminded the Board that he represented the applicant last year.At that time the Board '' <br /> indicated that the type of use being proposed was an asset to the community,however, it loll <br /> was a use that was not appropriate for the location. ' <br /> Attorney Kirrane stated that Mr.Menendez,President of Cape Cod Ventures,Inc., <br /> located another parcel of land situated on the southerly side of Route 28 next to Botello y �'� '' `'.t <br /> Lumber Yard and Percy s Restaurant. The building has not been used for over ten years } <br /> and has deteriorated. The site and the building on the site are both non-conforming. <br /> AttorneyKirrane stated that several ears ago the Town adopted a zoning by-law,which <br /> Y g P g Y � <br /> increased the frontage requirements to 600 feet in that area. However,there are large <br /> numbers of parcels of land that are commercially zoned that do not meet this new t: <br /> 600-foot frontage requirement.
