Mr.Dorgan clarified to the Board that there are no <br /> ancient ways in the Town of Mashpee. += <br /> �x <br /> •F <br /> Mr. Regan read letters from an abutter,Ms.Dorothy Hemingway, and abutters to Ms. <br /> Hemingway,Mr. and Mrs. John Chilingerian• The letters expressed approval of the ' <br /> Variance relief being sought by Mr.Alexander. 1W ` <br /> 4 4' <br /> Mr. John Skantz, an abutter who lives across the street, expressed concern that Mr. <br /> Alexander was seeking to divide the lot into two lots. Mr.Regan corrected Mr. Skantz , <br /> and stated that Mr. Alexander is seeking verification, due to Zoning By-law changes,that Ilk 4: <br /> the lot can be developed. ; <br /> t:E <br /> Mr.Dhan Haridat, an abutter next door to the applicant, submitted a letter from Mr.Mari <br /> and Erich Prinz neighbors, across the street from the applicant. The letter expressed � <br /> concern with the rural character of Horseshoe Bend Way. The letter claimed that the : <br /> subject property has no frontage on a road since the"Way" depicted on the Assessor s <br /> Map does not exist as a public way. The final argument was that current zoning calls for <br /> 80,000 square foot lots. The subject property consists of nearly 23,000 square feet. Mr. <br /> Haridat also expressed the same concerns regarding the rural character of the <br /> neighborhood. He claimed that any further development in the area will cause traffic ; �r <br /> problems if the road is used as a public way. Mr. Haridat questioned " ' � � �' <br /> p p y q d if the Way is �1 <br /> considered a public way. <br /> Mr. Regan reiterated that the subject lot has been in Mr.Alexander's family for 50 years <br /> •+rj <br /> and that he has been taxed and given betterment fees as a buildable lot. He further <br /> IS <br /> informed Mr. Haridat that, at this meeting,the Board was not determining whether or not <br /> the"Way"was considered a public way. ;,, -. ' <br /> 1C� • <br /> Mr.Dorgan referred to the deeds and documents referencing the"Way"and confirmed ' <br /> that the Way is mentioned as a private way. ' <br /> L <br /> Mr.Regan stated that the subject lot is larger than an of the other g � g y lots in the area. <br /> } <br /> Mr.Alexander stated that the lot had been billed as a buildable lot until about <br /> two yearsoil S' ..i <br /> ago. He was informed by the Tax Collector's department,that if he changed the status of :y} <br /> the lot to "property",the taxes would be lower and he could catch up on payment of the <br /> �' .� <br /> back taxes. ;44,r=� <br /> Mr. Cygan of 82 Horseshoe Bend Way addressed the Board. He stated that he was <br /> concerned with the rural nature of the neighborhood being ruined with more building.
