Li no sk Trustee Lin 'osk Famil Trust—Requests a Special Permit <br /> By-laws p under <br /> Section I74-25.I.9 of the Bonin <br /> g y laws for permission to construct a pier on John's <br /> Pond on property located in an R-5 zoningp district at I23 James Circle(Map 64 Block <br /> NI67)Mashpee, A. <br /> Sitting: James E. Regan III, Robert G.Nelson and Jame <br /> s M.Dorgan. <br /> `'* l <br /> Mr. Govoni stepped down. Mr.Regan invoked his position as a Special Municipal <br /> employee to allow for a quorum. <br /> Mr. Lipnosky represented his application and stated that the Conservation Commission <br /> has approved the project. The Board members studied ;s <br /> his submitted plans. <br /> .I <br /> Mr. Regan questioned if the Conservation Commission h as addressed the issue of `' 'r <br /> o,.fir � � €' <br /> clearing the vegetation in the area to allow for access to +`the pier. Mr. Lipnosky stated <br /> that he was instructed by Mr. Sherman of the Conservation " 'Commission.to avoid clear � <br /> cutting"the area. Mr. Lipnosky said that he preserve plans to <br /> p p rve as much as possible of the <br /> natural vegetation. <br /> Mr.David Ferreira, an abutter ex ressed c .<��' ' <br /> s p oncerns about the pier and boat being in close , %; <br /> proximity to his daughter's bedroom. ���� �gh om• He stated that noise from the pier and boat co <br /> pose a problem for his p could <br /> p s family. Mr. Ferreira questioned if the location of the pier could � <br /> Lipnosky p be <br /> moved. Mr. Li ,� •:ry. � . <br /> p y stated that the rest of the area is shallow and the overgrown <br /> vegetation does not allow for construction of the pier in another location. �. <br /> .Lipnosky <br /> stated that he is complying with Mr. Sherman's instructions on the l .ocation of the peter. <br /> No other comments were received from abutters. ...4 <br /> Mr.Nelson moved to ant the Special Permit sub'� p subject to findings 1, 3,4,5, subject to Plan <br /> dated 613199.
