Kanter and Bk#: 28505 <br /> Susan Wilson Page#: 342 <br /> 9 Kanter Lane <br /> (Map 119 Parcel 1D) <br /> Mashpee, MA 02649 <br /> A Petition was filed by request a Written Finding under Article V §174-17 <br /> (determine if it's more non-conforming) to allow for construction of an attached garage <br /> with living space above on property located in an R-3 Zoning District. Assessor's Map 119 <br /> Parcel 1D, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on June 19, 2015 and June 26, 2015 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 8, 2015 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ronald Bonvie, Richard Jodka, and Dom DeBarros, and Associate Member <br /> Scott Goldstein. Also present was Building Commissioner, Michael Mendoza. <br /> Mr. Kieran Healy, Land Surveyor with the BSC Group represented the owners for <br /> the proposed garage project. He provided a narrative, a plot plan, and building plans that <br /> depict the existing and proposed conditions of the lot that is situated on Waquoit Bay. The <br /> existing house and the side deck is non-conforming due to the side setback of being only <br /> 13.5' from the side lot line instead of the 15' requirement. The applicant is proposing to <br /> add an addition for a garage with living space above onto the existing home. The Board <br /> needs to determine if the addition would increase the non-conforming nature of the <br /> building. The project was approved by the Conservation Commission and the Board of <br /> Health. <br /> Jonathan read the Board of Health comments into the record; "The septic and floor <br /> plan have been approved for three bedrooms. This is considered an increase in flow from <br /> 2 to 3 bedrooms. The opening to the living room/office is only 5 feet. The BOH regulation <br /> for bedrooms is six feet so the new room above the garage can be considered a bedroom." <br /> 1 <br />
