Fuller <br />379 Mashpee Neck Road (Map 90 Parcel 57) <br />Mashpee, MA 02649 <br />FINDING-2015-40 <br />WRITTEN FINDING CRITERIA: <br />The Board approved the project with the following conditions; <br />The applicant meets all the conditions of a Written Finding under Mass General <br />Law 40A Section 6. <br />2. -The area is zoned R3 and is in the Pre -contact Archaeology Sensitivity area— listed <br />as "Moderate Sensitivity". The applicant must follow the instructions under bylaw <br />Section 174-24 (C) 3. <br />3. -The proposed single family home is within the AE Flood Zone. All work shall <br />conform to the MA State Building Code requirements for construction within an <br />AE Flood Zone. <br />4. An Existing and Proposed Site Plan titled: "Proposed House Reconstruction", and <br />subsurface sewage disposal system prepared for Steven & Donna Fuller, 379 <br />Mashpee Neck Road, Mashpee, MA, from BSS Design Engineering & Surveying, <br />164 Katharine Lee Bates Rd, Falmouth, MA 02540, Scale: 1" = 20', date: <br />September 10, 2015, draw by: TJB, Job number: 14238, Revisions: Changed <br />driveway from paved to crushed stone or shell, Sept. 16, 2015, TJB. Drawing <br />number B22-84. Signed by Thomas Jackson Bunker, and Jeffrey Edwin Ryther, <br />Registered Professional Engineers. <br />5. A Building Plan drawn by Cotuit Bay Design, LLC, 43 Brewster Road, Mashpee, <br />MA, titled; "New House for Fuller Residence, 379 Mashpee Neck Road, Mashpee, <br />MA. Scale: '/" = 1'-0", dated 9/28/2015, Al-A4. <br />6. Prior to construction a curb cut will be required by the Department of Public Works. <br />In view of the foregoing, the Board determined the Petitioner met the criteria for a <br />Written Finding. Upon motion duly made and seconded at the Public Hearings dated <br />Wednesday, November 18, 2015. The Zoning Board of Appeals voted unanimously to <br />issue a Written Finding to allow for a raze and replace of a single-family dwelling (based <br />on conditions listed above), to Donna J. Fuller and Steven P. Fuller, Trustees, on property <br />located at 379 Mashpee Neck Road, (Map 90 Parcel 57), Mashpee, MA. <br />
