Town c�, f 1ashpee <br />N <br />16 Great Nck !kwd Aorth <br />Alasilpee, Alassachttsetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A WRITTEN FINDING <br />FINDING-2015-41 <br />Alan George Hatt and Bk#: 29064 <br />Janet Lynn Hatt, Trustees of The Page#: 325 <br />Dudley Duck 2014 Realty Trust <br />18 East Road (Map 1 Parcel 7) <br />Mashpee, MA 02649 <br />A Petition was filed on October 1, 2015 by Alan Hatt requesting a Written Finding <br />under Article V §174-17 to allow for construction of a deck and stairs on property located <br />in an R-5 Zoning District, at 18 East Road, (Map 1 Parcel 7), Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws <br />Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br />general circulation in the Town of Mashpee, on October 9, 2015 and October 16, 2015 a <br />copy of which is attached hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br />Zoning By-laws. <br />This hearing was scheduled for October 28, 2015 but was continued to November <br />18, 2015 because there was no quorum. <br />Public Hearings were held on the Petition at the Mashpee Town Hall on <br />Wednesday, November 18, 2015 at which time the following members of the Board of <br />Appeals were present and acting on this hearing; Chairman, Jonathan Furbush, Vice <br />Chairman, William Blaisdell, Board Members, Richard Jodka, Dom DeBarros, and <br />Associate Member, Scott Goldstein. <br />Mr. Alan Hatt represented himself and stated he meets all the setback requirements <br />except for the 40 feet in the front. He's requesting 3 ft. from the front setback. <br />Mr. Furbush stated the project does not require relief from the front because the <br />closest distance from the back street is 22.2 ft., and the plan depicts 26.1 feet. <br />Mr. Blaisdell stated the project is not more detrimental to the neighborhood than <br />what currently exists. <br />Mr. Furbush read the Conservation Comments into the record; "property is not <br />within wetlands jurisdiction." And the Board of Health comments into the record; "owner <br />and builder have been in to discuss the project with the Board of Health. The plans have <br />been revised to accommodate the septic tank. No further comments." <br />
