No#: 1193511 <br /> 156 Waterway Certificate#: 197310 <br /> (Map 105 Parcel 238) <br /> Mashpee, MA 02649 <br /> A Petition was filed on October 9,2015 by Jason Stone requesting a Variance under <br /> §174-31 of the Zoning Bylaws for relief from the front setback to allow for construction of <br /> a 10 x 12 shed on property located in an R-3 Zoning District, at 156 Waterway, (Map 105 <br /> Parcel 238), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on October 30, 2015 and November 6, 2015 <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 18, 2015 at which time the following members of the Board of <br /> Appeals were present and acting on this hearing; Chairman, Jonathan Furbush, Vice <br /> Chairman, William Blaisdell, Board Members, Richard Jodka, Dom DeBarros, and <br /> Associate Member,Norman J. Gould. <br /> Mr. Kevin Kirrane, Attorney represented the homeowner for the shed project. Also <br /> present Jason Stone,homeowner.Mr.Kirrane said that Mr. Stone received some inaccurate <br /> information when he purchased the shed. He was led to believe that the 120 sq. ft. shed <br /> didn't have setback issues. However, under the bylaw the setbacks for a shed is five feet <br /> from the rear and side yard, setbacks and 40 feet from the front yard setback. As a result, <br /> Mr. Stone bought the shed and located it on his property, and discovered he needed relief <br /> from the Board as it relates to the location. The shed is approximately 9.8 ft. from the front <br /> yard lot line. The front lot line is 10 feet from the paved surface. Mr. Stone wants to store <br /> a small watercraft and prefers to have the shed in the front because the property has a <br /> significant drop from the street toward the water. He considers this a hardship as it relates <br /> to the topography of the lot. <br /> 1 <br />
