Submission made by the Charter Bylaw Review Committee <br /> amending Sec. 174-95 to increase the powers of the Zoning <br /> Board of Appeals to include those currently held by the <br /> Subdivision Board of Appeals which may issue building <br /> permits which would otherwise be prohibited by Planning <br /> Board road construction standards or subdivision approval <br /> onditions . <br /> Submission by the Zoning Board of Appeals amending <br /> Sec. 174-91 to change the term of Zoning Board of Appeals <br /> members back t.o three ( ) years from' the five ) gears <br /> adopted October 2003. <br /> Submission by the Zoning Board of Appeals and Planning <br /> Board amending Sec. 174-92 specifically authorizing the <br /> Zoning Board of Appeals to elect a vice Chairman. <br /> Submission- by the Zoning Board of Appeals and Planning <br /> Board amending Sec. 17 - 4 C-9 to specify that modification <br /> of the Zoning Board of Appeals special permit requ-ires <br /> approval of four ) or five ( ) members of the Board as- <br /> provided in the State Zoning Act. <br /> Article 1 - The Assistant Town Planner explained the <br /> Town Planner is advising that the Board vote against this <br /> article. one issue of concern being the submission (by the <br /> Charter Bylaw Review Committee) ; the ether being <br /> authorization of the Zoning Board of Appeals to <br /> review/appeal road design matters, taking that process away <br /> from the Planning Board and Department of Public Works . <br /> The Chair-man recognized Bob Nelson, Zoning Board of <br /> Appeals, who explained the Charter Commission proposed this <br /> article, not the Zoning Board of Appeals . However, the <br /> Zoning Board of Appeals is not in opposition to assuming <br /> this responsibility. He dial inform the Planning Board that <br /> e would support the Planning Board decision in this <br /> matter. <br /> There being no public comment the Chairman entertained <br /> a motion. <br /> MOTION: Steve Dolan made a Motion to make "No <br /> Recommendation" on Article 15, with the understanding said <br /> vote will table the article; which Motion was duly seconded <br /> by Lee Gurney and so voted unanimously. - <br /> 2 <br />
