Public Hearing <br /> c. Talanian Realty company <br /> Donna'Donna' s Lane Route 28 <br /> South Cape Village Special Permit Modification <br /> The appointed hour laving arrived the chairman read <br /> the Hearing Notice into the Record and called the Public <br /> Hearing in this matter to order. <br /> The chairman recognized Mr. Megathlin who suggested <br /> this matter be postponed to a subsequent date. However, he <br /> did request that he be allowed to update the Board on the <br /> status of this matter: <br /> Most of Shellback Way has been completed as approved <br /> by the Planning Board in the 2003 special Permit, with the <br /> following exceptions . Waivers were granted by the Board of <br /> Appeals in their 2004 Decision to Plymouth savings Ban} , <br /> which is now Eastern Bank. Said waivers do not conform to <br /> the Planning Board plans . The Board of Appeals plan did <br /> -not close one of the curb cuts, and no improvements <br /> {ci.rculation and parking) have been made in front of the <br /> Hardware store . There was however an alternate plan <br /> included within the Board of Appeals plan that was never <br /> adopted. <br /> Mr. Megathlin made reference to the plan approved by <br /> the Planning Board .indicating the location of Route 28, <br /> South cape village, Shellback Way, and Deer crossing. The <br /> Planning Board approved closure of one of the curb cuts, <br /> the Bank has agreed to close one of the curb cuts as well . <br /> There had been -some improvements proposed in front of the <br /> True value Hardwaire Store, which have not been approved b <br /> the Board of Appeals . <br /> The Board of Appeals has approved a plan indicating a <br /> curb cut onto Shellback Way, with no improvements suggested <br /> in front of the True value Hardware Store. <br /> Mr. Megathlin- suggested the project could not continue <br /> without some direction/solution being made by the Planning <br /> Board. He made reference to condition #13 of the Special <br /> Permit that allows flexibility of time. However, the <br /> matter is further complicated by the fact that Eastern Ban] <br /> has been issued a building. permit and is about to began <br /> construction.. <br /> 3 <br />
