Bellis and Certificate of Title: 200997 <br /> Susan E. Dacey-Bellis Lot#: 81 <br /> 150 Waterway Plan#: 11408-23 <br /> Mashpee, MA 02649 <br /> A Petition was filed on February 5, 2014 by Donald S. Bellis and Susan E. Dacey- <br /> Bellis requesting a Written Finding under Article V §174-17 of the Zoning By-laws and <br /> M.G.L. Chapter 40A §6 concerning continuance, extension or alteration of a pre-existing, <br /> non-conforming structure to allow for construction of a new single family dwelling on <br /> property located in an R-3 Zoning District on property located at 150 Waterway, (Map 105 <br /> Parcel 237), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on February 21, 2014 and February 28, 2014 <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> On March 12, 2014, Public Hearings were held on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Board were present and acting <br /> throughout; Chairman, Jonathan Furbush, Vice Chairman, William A. Blaisdell, Board <br /> Member,James Reiffai-th,Associate Members,Domingo K.DeBarros and Scott Goldstein, <br /> and Building Commissioner, Richard E. Morgan. <br /> Attorney, Kevin Kirrane representing the applicants, Donald and Susan Bellis, for <br /> the raze and replace project. He provided the Board with a written narrative, a land court <br /> plan, and pictures of the job site. He stated that Tim Luff, of Archi-Tech Associates will <br /> be available to answer any questions regarding the proposed plans of the new dwelling. <br /> The property currently exists on 17,500 square feet with 100 feet of frontage and is <br /> a pre-existing non-conforming lot. Mr. Kirrane provided the Board a subdivision plan of <br /> Waterway showing the boundary on Popponesset Creek. There has been significant <br /> substantial changes in typography of the lot that drops off from Waterway down to the <br /> water. <br /> 1 <br />
