The appointed hour having arrived the Chairman called the Public Hearing to <br /> order and recognized Attorney Jack McElhinney, representing the Applicant, who <br /> introduced David wood and Matthew Eddy. <br /> Attorney McElhinney addressed a matter that was raised at a recent Plan review <br /> Committee meeting in which Applicant misrepresented themselves at the January 21, <br /> 2009 Planning Board Meeting, by stating that the abutters were in agreement with the <br /> proposed plan. He then made reference to a memo sent-:to all of the abutters on January <br /> , 2009 informing them that the-Public Hearing had been continued to January 21, 2009. <br /> .Attorney Mclhinney stated that.he feels the Applicant has done their job well in <br /> meeting with the Planning board; Plan review Committee,Natural Heritage, the <br /> abutters,'and those who will be most impacted Scott and Deb l ravis on an individual <br /> basis. He f rther stated they the Applicant has made every effort to keep the abutters <br /> informed. <br /> Attorney McElhinney then provided copies of all a-mails that have been sent to <br /> the abutters.with regard to this matter dating back,t February 2001 . <br /> Attorney McElhinney then reviewed that the application is for the 27 th <br /> Modification to the Willowbend Special Permit originally issued in 1991. Applicant-is <br /> proceeding under the bylaw to increase the unit count from the currently permitted 22 <br /> units to a total of 263 units, a 40-unit increase with 8-units on Fin Me Oot Road which <br /> will be supplemented, which consists of the 4 -units currently under rvier. There is a <br /> section ofthe bylaw which allows an Applicant with a-Special Permit to incorporate <br /> additional adjacent land under the terms of the Permit.Perrnit.as long as the total number-of units <br /> is not increased. <br /> Applicant is in compliance with all of the criteria for the issuance of the Permit. <br /> The proposed project is a cluster concept with 4 -units on 11-acres. willowbend has an <br /> excess of 440-acres of land of which over Zoo-acres are permanently restricted <br /> conservation land that can never be built upon under state and local laves. This particular <br /> portion of the property is dense with buildings; however there are other areas on the <br /> project with -units per acre. The willowbend community pays over 14 million dollars <br /> per year in real estate taxes with minimal demands upon the Town, there are less than six <br /> children living within the entire project. Applicant has been a very good corporate <br /> citizen in supporting local charities and availing their facilities to the community as well. <br /> Matt Eddy, Baxter&Nye Engineering addressed the board making references to <br /> the revised plan, "Willo bend Development LLC buffer Cross-Section Conceptual <br /> Planting Plan, willowbend Golf villas at Sirnon.'s Road,-1 iashpee, Massachusetts, slated <br /> 02-12-09, by Baxter Nye Engineering& Surveying; Comdex and villa Units, Simon1s <br /> Road, willowbend Country Club, Mashpee, Massachusetts, dated 02-04-09, by Baxter <br /> r <br /> Nye Engineering& Surveying". <br /> 6 <br />
