MOTION: Joseph Mullin read a Motion in the form off-a Finding-that there have <br /> been specific and material changes pursuant to General Lave 40A Section 16, in the <br /> conditions upon which the previous unfavorable action was based. The new plans for <br /> South Cape Village submitted-to the Planning Board at their Wednesday, April 1,2009 <br /> Meeting has shown enough changes to allow said plans to be resubmitted within two 2 <br /> years. The changes consist of a relocation of the loading-zones and sidewalks have been <br /> widened on one side, resulting in four less parking spaces resulting in a better plan; <br /> which Motion was duly seconded by Al Wicket and so voted tmanimously. <br /> Voting.in Favor of the Motion: Dennis l al arini, Joseph Mullin, and Al Wickel. <br /> Opposed to the Motion: James Leonard and Diary Waygan. <br /> (The Notion failed as approval requires four favorable votes of the Planning <br /> Board.) <br /> Special Permit <br /> lashpee Investors LL -South Cape Village Shopping Center <br /> Special Permit Modification to Convert Joy Street Pedestrian Walkway to a Street and <br /> Parking Area . <br /> The Vice-Chairman called this matter to order and recognized Matthew Eddy, <br /> representing the Applicant. <br /> Mr. Eddy asked ed to respectfully withdraw-the Special Permit Application, without <br /> prejudice, in this matter; to which the Planning Board agreed. <br /> Said request for withdrawal was also submitted in writing to the Town Planner. <br /> "Mashpee Investors LLC withdraws without prejudice the Special Permit Modification <br /> Application for Modification to Joy Street filed with the Town Clerk on February 25, <br /> 2009.
