MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Kristen P. Van Beek <br /> 357 Monomoscoy Road, (Map 120 Parcel 19) <br /> Mashpee, MA 02649 <br /> FINDING-2014-32 <br /> The lot is long and narrow with only 50 feet of non-conforming frontage on <br /> Monomoscoy Road, and consists of 21,250 square feet. The engineering plan depicts the <br /> existing dwelling closest to Little River being 6.1 feet from the Southwesterly side property <br /> line, and 10.8 feet from the Northwesterly side property line. The new proposed structure <br /> will continue the 10.8 foot dimension on the Northeasterly property line, but will improve <br /> the setback on the Southeasterly line from 6.1 feet to 11 feet. <br /> The garage/cottage structure is 8.4 feet from the Northwesterly property line and <br /> proposing to maintain the same 8.4 feet at the Northeasterly location and will increase the <br /> setback from the Southwesterly property line,and currently 16.5 feet to 19.6 feet will retain <br /> the same non-conforming condition on the property line to the North. <br /> The new structure conforms to the setback criteria on Monomoscoy Road and is <br /> outside the 50 foot buffer of any wetland criteria. As shown on the plan, the overall use is <br /> reducing the intensity use on the lot, and improving the setback criteria. A new Title 5 <br /> septic system will be installed to service both new structures and only occupy 16.8% of the <br /> site that is well within the allowed 20%. <br /> Mr. Furbush read Board of Health comments into the record; "Floor plans show a <br /> proposed three-bedroom dwelling and one bedroom above the proposed garage. Existing <br /> septic is new in 2011 for four bedrooms. BOH approves proposed floor plans." <br /> Mr. Furbush read Conservation comments into the record; "approved the <br /> application". <br /> There were no abutters present. <br /> GENERAL FINDINGS: <br /> The subject property located at 357 Monomoscoy Road consists of 21,250 <br /> square feet. <br /> WRITTEN FINDING CRITERIA: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or <br /> uses may be continued, although not conforming with the provisions of this chapter. Non- <br /> conforming single-or two-family dwelling structures may be changed, extended or altered <br /> if such change, extension or alteration complies with the dimensional requirements <br /> applicable to the lot under current provisions of §174-31 or, for lots which have been <br /> developed pursuant to §174-21, complies with such requirements as were applicable to <br /> initial construction of the dwelling under provisions of§174-21. <br /> 2 <br />
