Wagner Caffyn Certificate of Title#: 192799 <br /> 10 Popponesset Island Road Land Court Lot#: 1047 <br /> (Map 105 Parcel 267A) Plan#: 11408-91 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 28, 2014 by Leslie A. Wagner Caffyn requesting a <br /> Written Finding under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A <br /> §6 concerning continuance, extension or alteration of a pre-existing, non-confonming <br /> structure to allow for construction of a 822 sq. ft. addition which includes finishing one- <br /> half of the upper story that currently serves as a bedroom and attic space, as well as adding <br /> a modest addition, breezeway, and garage to the existing foot print of the structure on <br /> property located in an R-3 Zoning District at 10 Popponesset Island Road, (Map 105 Parcel <br /> 267A), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on August 8, 2014 and August 15, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 27, 2014 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members,James Reiffarth,Richard Jodka,and Associate Members,Dom DeBarros, <br /> and Scott Goldstein. Also present was Building Commissioner, Michael Mendoza. <br /> Attorney, Kevin Kirrane represented the Petitioner, Leslie Caffyn in connection <br /> with the application before the Board for a specific finding, and if necessary, a front yard <br /> variance. He provided the Board with pictures, and appended a copy of the land court plan <br /> with the written remarks that show the unique shape of the lot and how it impacts the <br /> wetland resource areas. The parcel is uniquely shaped on a peninsula, and there is no <br /> frontage. The lot is accessed over a 15 foot wide way to Popponesset Island Road and <br /> contains 53,600 square feet which makes it conforming by a size perspective,but does not <br /> have any fontage. <br /> 1 <br />
