Moskowitz Land Court Lot#: 52 <br /> 146 Popponesset Island Road Plan#: 11408-12 <br /> (Map 112 Parcel 10) <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 21, 2014 by Michael Moskowitz requesting a Written <br /> Finding under Article V §174-17 of the Zoning By-laws and M.G.L. Chapter 40A §6 <br /> concerning continuance, extension or alteration of a pre-existing,non-conforming structure <br /> to allow for construction of a 528 sq. ft. addition on the Southerly side of the dwelling and <br /> to add some additional living space above the existing garage on property located in an R- <br /> 3 Zoning District at 146 Popponesset Island Road, (Map 112. Parcel 10), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on August 8, 2014 and August 15, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 27, 2014 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Members,James Reiffarth,Richard Jodka,and Associate Members,Dom DeBarros, <br /> and Scott Goldstein. Also present was Building Commissioner, Michael Mendoza. <br /> Attorney, Kevin Kirrane represented the Petitioner, Mr. Moskowitz regarding a <br /> specific finding at 146 Popponesset Island Road. He provided the Board with a narrative, <br /> photos, and plot plan that highlights the existing structure.The proposal includes additional <br /> living space above the garage, (not increasing the footprint of the building), and a 528 <br /> square foot addition on the Southerly side. <br /> The property has 125 feet square feet of frontage on Popponesset Island Road, and <br /> the lot is about 17,300 square feet,abutting Popponesset Bay.The structure fails to conform <br /> to the side line setback criteria at 10 feet on the northerly side, and fails to conform to the <br /> 50 foot setback criteria of the wetlands because it is 21 feet from the seawall. The existing <br /> house occupies 16.67%of the lot, and 17.14%,if including the dock on the outland section <br /> of the property. <br /> 1 <br />
