MASHPEE ZONING BOARD OF APPEALS <br />FEBRUARY 13, 2013 <br />MINUTES <br />• <br />Mr. Bonvie makes a motion to approve 12.6 ft. variance from the rear setback to the <br />North Westerly side of the conservation property, and a 2.6 variance from the' Westerly <br />side abutting the lot number 63. This is conditioned upon compliance with Yankee <br />Survey Land Survey Company plan entitled: site plot plan referring located at 7 Chicory, <br />prepared for Barry Sahl, November 1, 2012 revised November 7, 2012, 7.4 ft on the <br />original plan. Mr. Furbush seconds the motion. Votes: Mr. Furbush, yes, Mr. Blaisdell, <br />yes, Mr. Dorsey, yes, Mr. Reiffarth, yes, Mr. DeBarros, yes. Vote was unanimous. <br />• <br />NEW HEARINGS <br />SBA Properties, Inc.: <br />Requests Extension of Special Permit SP -97-70 to allow for an existing radio <br />telecommunications facility and associated equipment permitted under §§174-25.B(6), <br />174-25.1)(5) and 174-25.H(6) of the Zoning By-laws on property located in'an I-1 zoning <br />district at 154 Industrial Drive (Map 88 Parcel 31) Mashpee, MA. This request is in <br />compliance with conditions of the 1997 ZBA Decision, which expires on March 23, <br />2013. <br />Sitting: Board Members Jonathan D. Forbush, William A. Blaisdell, Ronald S. Bonvie <br />and James Reiffarth and Associate Member Domingo K. DeBarros. <br />Attorney Park Sheffield represented SBA Communications Towers, the owner of the 250 <br />ft tower located at 154 Industrial Drive, Mashpee, MA. Attorney Sheffield recommended <br />that the Board, require the Petitioner to post a removal bond of $25,000. <br />Mr. Furbush asked Attorney Sheffield if he was familiar with the noise study. Attorney <br />Sheffield mentioned he is not an expert on noise studies. Mr. Furbush.asked about the <br />letter to Diane Borchardt, SBA Communications signed by Ian Ormesher, Director, of <br />Profile Marketing Associates. <br />Mr. Furbush wants Attorney Sheffield to research the noise study and the RFR from the <br />engineer and email his findings. <br />Mr. Bonvie made a motion to approve the extension of the special permit, 97-70 issued to <br />SBA Properties, Inc. <br />3 <br />
