MASHPEE ZONING BOARD OF APPEALS <br />FEBRUARY 13, 2013 <br />• MINUTES <br />Attorney Kirrane stated that the 20 foot front setback as well as the 30 foot setback to the <br />wet -land area is more than adequate setbacks. He suggested that there is certainly <br />adequate parking for this two bedroom dwelling. <br />Mr. Furbush questioned the back deck above and thought the proposed deck was lower <br />than the other deck. Attorney Kirrane said it is just an extension. The deck is above <br />ground and there's a patio. He further mentioned it was the narrowest portion of the <br />building, and the deepest portion of the deck. The extra space is necessary to put a table <br />and chair. That's the intent of that expansion. <br />Attorney Kirrane stated that most of the area is in a flood zone. <br />Designer Timothy Luff mentioned that the new addition will have the appropriate flood <br />panels. This is an A Zone and the water has to be able to enter and exit the criteria of one <br />square inch per square foot. That will be on the foundation plan which will be used for <br />storage. ' <br />The bedroom is being removed and the Board of Health requested the door removed. <br />• Tim answered; the addition will have an impervious membrane around its regular tank. <br />Mr. Furbush read an interoffice memo, dated February 12, 2013 from Veronica Warden, <br />Asst. Health Agent (196 Waterway) in Zone II. The dwelling is restricted to two <br />bedrooms. The proposed additions and one additional bedroom. The architectural plans <br />that were submitted depict the basement bedroom to be removed. This will be <br />incorporated into the Decision. <br />Mr. Bonvie makes a motion to approve the Petition for a Written Finding. <br />In said finding the Board also states that the proposal is not substantially more <br />detrimental than the existing non conforming structure. The new dwelling will be an <br />improvement and will conform to current building code requirements and it is compatible <br />in size and character of other structures in the neighborhood and there is sufficient <br />parking and setbacks as may be required. This is conditioned upon removal of the <br />existing shed, and the squaring off of a patio with removal of 146 square feet of deck. <br />Total lot coverage will be 20% after completion of the improvements. <br />This Decision is also conditioned upon compliance with the Board of Health memo <br />requiring removal of a bedroom so that the maximum bedroom count will be two <br />bedrooms. This is conditioned upon compliance with plans that refer to this project <br />drafted by DSS Design & Engineering and Surveying, Plot Plan of the proposed prepared <br />• for William P. Tommasino and Deborah D. Thornton 196 Waterway, New Seabury, MA. <br />Scale 1" = 20 dated November 14, 2012, drawn EJP, TJB, Job number 12185, and <br />drawing number P20-107. <br />5 <br />
