MASHPEE ZONING BOARD OF APPEALS <br />• FEBRUARY 27, 2013 <br />MINUTES <br />Mr. Brian Riley, announced himself as co-owner of the property located at 42 <br />Jackbon, Mashpee, MA, which abuts Mr. Monahan's property. He addressed the <br />Board asking who owned the two house lots behind his and Mr. Monahan's <br />properties, and if they abut against conservation land. . <br />Mr. Furbush said the plans do not show who owns the property behind the <br />structure. <br />Mr. Riley asked the Board and Mr. Monahan's intention of putting in a new septic <br />tank and new leaching field would accommodate up to a five bedroom dwelling? <br />Mr. Morgan confirmed the plans accommodate a three (3) bedroom dwelling. <br />Mr. Blaisdell made a motion to approve Michael and Tammy Monahan's request <br />for a written finding under 174-17 of the Zoning Bylaws and MGL Chapter 40A 6 <br />concerning continuance, extension or alteration of pre-existing non -conforming <br />structures to allow for construction of a new dwelling on property located in an R- <br />3 zoning district at 36 Jackbon Road, Map 90, Parcel 36, Mashpee, MA. <br />In addition Mr. Blaisdell made a motion to approve Michael and Tammy <br />Monahan's request for a special permit under 174-20 of the Zoning Bylaws <br />concerning rebuilding of destroyed or damaged non -conforming structures to <br />allow for re -building of a single family dwelling on property located in an R-3 <br />zoning district at 36 Jackbon Road, Map 90 Parcel 36, Mashpee, MA. <br />This is contingent upon the following: <br />-Removal of the shed at the rear of the lot, which is the Northern side of <br />the lot. <br />-Removal of the screened gazebo in the front of the lot, adjacent to <br />Jackbon Road. <br />Final Board of Health approval, and this proposal is compliant with the <br />dimensional requirements of the building inspector and the proposal is not <br />substantially more detrimental than what exists today. <br />-Has adequate parking. <br />- Is based on a plot plan developed by BSS Design, Engineering and <br />Surveying dated January 28, 2013 developed and prepared for Michael <br />Monahan, by Jeffrey Edwin Ryther, Registered Professional Engineer. <br />ki <br />
