MASHPEE ZONING BOARD OF APPEALS <br />• FEBRUARY 27, 2013 <br />MINUTES. <br />Mr. Monahan stated the new structure will comply with Town of Mashpee <br />Bylaws of 15 feet both sides and back, and 40 feet from the front. He is also <br />removing the existing septic tank and installing a new tank to accommodate a <br />three bedroom dwelling designed by BSS Design & Engineering & Surveying. <br />Mr. Furbush confirmed with Mr. Monahan that the planned driveway <br />accommodates two vehicles as required by the Town Zoning Bylaws. <br />Mr. Furbush asked Mr. Monahan if the rock wall located on the right side of the <br />property belongs to him, and Mr. Monahan said; "yes, it does". <br />Mr. Furbush read the Interoffice Memorandum from the Board of Health stating <br />the following: <br />"To Board of Appeals from Veronica Warden, Assistant Health Agent, dated <br />February 26, 2013, referencing February 27, 2013 Board of Appeals Public <br />Hearing. Michael and Tammy Monahan (36 Jackbon Road) — Not in a Zone H. <br />• The Board of Health has not received any site and design plans for this lot <br />however; a percolation test was , performed on December 13, 2012. Plans <br />submitted to the Board of Appeals are for a three bedroom dwelling with no <br />variance relief from State or local Board of Health regulations. A long as town <br />water services the dwelling, the owner could install tip to a five bedroom leaching <br />facility on the lot. " <br />• <br />Mr. Monahan commented he brought the plans to the Board of Health and they <br />were signed by Glen Harrington and the Conservation Department. <br />Mr. Furbush advised to Mr. Monahan to call the Board of Health and confirm that <br />they have the, documented site and design plans because this will be contingent <br />upon moving forward with the project. <br />Mr. Furbush asked if there were any further questions from the Board or <br />audience. <br />Mr. Pat Riley, announced himself as co-owner of the property located at 42 <br />Jackbon, Mashpee, MA, which abuts Mr. Monahan's property. He addressed the <br />Board and asked Mr. Monahan to confirm that his intentions are to keep the <br />aesthetics of the rock wall. Mr. Monahan confirmed he has no intention of <br />removing the rock wall because it is preventing soil erosion on the property. <br />2 <br />
