Town of Mashpee <br />S A <br />76 Great Aeck load d\rorYh <br />4`b waw Maslrpee, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />MARCH 13, 2013 <br />MINUTES <br />The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, <br />March 13, 2013, at 6:00 p.m. in the Waquoit Conference Room at the Mashpee <br />Town Hall, 16 Great Neck Road North. Board Members Jonathan D. Furbush, <br />Williams A. Blaisdell, Ronald S. Bonvie and James Reiffarth and Associate <br />Member Domingo K. DeBarros were present. Building Commissioner Richard E. <br />Morgan was also present. Board Members Judith Horton and John Dorsey were <br />absent. <br />Chairman Jonathan D.Furbush opened the meeting at 6:00 p.m. He announced the <br />meeting was being televised on local Mashpee television. <br />PLEDGE OF ALLEGIANCE <br />is <br />Jeffrey R. and Sheila Evdenbere, Trustees: Request a Special Permit under <br />§§174-63 and 174-27.2 of the Zoning By-laws concerning variation of restrictions <br />under Article XI Flood Plain Zone Provisions and Storm. Water Management to <br />raise the grade on the property located in an R-3 Zoning District at 16 Squaws <br />Lane (Map 117 Parcel 83) Mashpee, MA. <br />John Slavinsky, with Cape & Islands Engineering, 800 Falmouth Road, Suite <br />301C, Mashpee, MA, introduced himself to the Board representing the <br />Eydenbergs and presented plans to the Board that depict the demolition of the <br />existing dwelling and new construction of a three-bedroom dwelling. <br />Mr. Slavinsky met with the Conservation Department on February 13, 2013 and <br />the Board of Health on February 14, 2013 to obtain the proper signatures before <br />filing with the Building Department because this particular dwelling is in a flood <br />zone. At that time, the Building Department requested a special permit for §174- <br />63 & §174-27.2 be presented to the Zoning Board of Appeals. <br />Mr. Slavinsky agreed to file for zoning relief under §174-27.2 "Storm Water <br />Management", but disagreed to file under §174-63 "Variation of Restrictions" He <br />believes that §174-63 is the zoning bylaw for areas similar to Popponesset stating <br />the Board would allow a particular homeowner to knock down and rebuild a <br />home in an area surrounded by smaller homes located in an elevation 12 flood <br />zone with the first floor at an elevation 8 flood zone. <br />• <br />
