Mr. Slavinsky mentioned that under §174-64 the Zoning Board of Appeals must <br />• submit an annual report to FEMA referencing a house built that does not conform <br />to the flood zone rules and regulations. He said the Building Commissioner asked <br />for a profile showing dimensions of the fill that depicts the cross section of the <br />ground water at the rear of the property to the cover on the septic and soil <br />absorption system. When he filed this information with the Board of Health; his <br />plans showed two walls because he could not transpose the picture of lot 14 <br />located to the left of the proposed lot. He mentioned his dimensions were within <br />inches of the existing average grade of a wall in the rear and a wall along the <br />beach front property. The Board of Health wanted a wall as opposed to a swale <br />due to the design. <br />Mr. Slavinsky agreed to filing under §174-27.2 because he is going to stop the <br />water from flowing onto the abutting properties. He believes he should file under <br />bylaws §174-65 and §174-66 referring to a comment by FEMA that states a <br />project located on a flood zone map would allow or disallow you to complete a <br />project and file an ALOMA F. which stands for "a letter of map amending". He <br />found three similar projects in the Town of Mashpee; Uncle Henry's, Popponesset <br />Island, and the last lot in the Meadowbrook subdivision that abuts Monomoscoy. <br />Mr. Slavinsky said he submitted documentation admitting he is changing the <br />drainage patterns. He said all abutters, and some of Squaws Lane are actually <br />sending their water onto this property. The lot fill on the back of this property is at <br />• the absolute minimum elevation. Digging a four (4) foot hole would reach ground <br />water. The DEP and the Town of Mashpee stated that the bottom of the septic <br />system and the sole absorption system has to be five (5) feet above ground water. <br />Mr. Slavinsky said he will install one (1) foot shallow depth concrete units as <br />opposed to two (2) feet in depth with nine (9) inches of fill over the distribution <br />box and back over the tank to be compliant with The Town of Mashpee and Title <br />V, but could alternatively add enough fill to raise fifteen (15) feet above the flood <br />zone level. The flood zone between Waquoit Bay, Popponesset Bay, and along <br />the shore line, is 117 million square feet. He said his 450 yards of fill would raise <br />the grade level 1.4 thousands of an inch to the shore line. That's about one third <br />the width of a human hair. He said he has performed many similar projects in the <br />past and did not require filing with the Zoning Board of Appeals. He referred to a <br />February 13, 2013 hearing that are installing 850 cubic yards of sand in a V -zone <br />on Maushop Beach. <br />On February 13' 2013, Mr. Slavinsky went to the Board of Health, and one <br />particular member had a problem with water flowing onto Squaws Lane. He said <br />there's going to be less now because there will be new sod, new dry wells or a <br />French drain below the drip edges. He said he will capture more water than what <br />is currently captured. He will incorporate a French drain on the entire front along <br />the street that runs from property line to property line. <br />is <br />Mr. Slavinsky said a couple years ago with limited funding, he gave this project a <br />"band aid" approach to lessen the water puddle.
