Richard Morgan would like to make sure these walls are not constructed with <br />• wood. <br />Bill Blaisdell made a motion to approve Jeffrey R. and Sheila Eydenberg, <br />Trustees: Request for a Special Permit under §174-63 and §174-27.2 of the <br />Zoning By-laws concerning variation of restrictions under Article XI Flood Plane <br />Zone Provisions and Storm Water Management to raise the grade on property <br />located in an R-3 Zoning District at 16 Squaws Lane (Map 117 Parcel 83) <br />Mashpee, MA. This has been continued to March 27, 2013. <br />This is conditioned upon a masonry material wall be installed, (not wooden <br />material) surrounds the property other than the concrete containment wall and the <br />proposed house reconstruction plan at 16 Squaws Lane prepared by Cape & <br />Islands Engineering, 800 Falmouth Road Suite 301C, Mashpee, MA, dated <br />January 23, 2013 and revised March 20, 2013. <br />This is also conditioned upon the description of the Concrete Containment Wall, <br />stamped by Richard James Bertrand, Professional Engineer, and three Hydrocad <br />Reports. A report entitled Existing Runoff, Roof Runoff Only dated March 18, <br />2013, prepared by Cape & Island Engineering, a report entitled, Existing Runoff, <br />Residential Area, dated March 18, 2013, prepared by Cape & Island Engineering <br />and a report entitled Existing Runoff, Residential Area, Lawn and Gravel <br />Drive/Parking, dated March 18, 2013, developed by Cape & Islands Engineering. <br />• Jim Reiffarth seconded the motion. Votes: Jon Furbush, yes, Bill Blaisdell, yes, <br />Judy Horton, yes, Dom DeBarros, yes, and John Dorsey, yes, all in favor. <br />OPEN DISCUSSION: <br />Judy Horton, Board Member read the open discussion request. <br />Jobs -Whitings Trust: Request an open discussion of Chapter 40B (Mashpee <br />Commons) Comprehensive Plan Permit granted to Jobs -Whitings Trust on <br />February 7, 2007 for property located off Rt. 151 and Rt.28 comprised of parcels <br />shown as Map 73, Lot 10, Map 74, Lot 34 and Map 74, Lot 20. <br />Douglas Storrs introduced himself representing Jobs -Whitings Trust and <br />introduced Councilor Michael Ford. The current comprehensive permit issued by <br />the Zoning Board was extended through February 15, 2013. Doug stated in one <br />sense one might see the permit has lapsed within the time frame. However, there <br />are a lot of peculiarities in the comforts of permits. This permit was issued by the <br />Zoning Board and then there was a peculiarity of the Planning Board and the <br />Cape Cod Commission Planning stating they had a role because there is a <br />commercial component, and we said; "they didn't." It was decided to resolve this <br />by going to the Planning Board for a Special Permit for just a commercial permit. <br />Those permits were issued obviously after the Zoning Board permit. <br />al <br />
