0 <br />• <br />0 <br />MASHPEE ZONING BOARD OF APPEALS <br />APRIL 24, 2013 <br />MINUTES <br />Rachel M. & Errol W. Hicks, Trustees: <br />Request a Special Permit under §174-20 of the Zoning By-laws concerning <br />rebuilding of destroyed or damaged non -conforming structures to allow for <br />rebuilding of a single-family dwelling on property located in an R-3 Zoning <br />District at 47 Orchard Road (Map 62 Parcel 3), Mashpee, MA. <br />John Slavinsky announced that he is representing Rachel M. & Errol W. Hicks. <br />The lot is 14,500 square feet. Lot coverage will be 8%, is 45 feet setback and 23 <br />feet on both sides. The height of the dwelling will be 35 feet, and a shed will be <br />constructed. This does not include the existing structure to be razed. The driveway <br />is within the boundary lines. <br />Ron Bonvie read the comment from the Board of Health, stating Rachel M. & <br />Errol W. Hicks, 47 Orchard Road is not in Zone II, there is no restriction on the <br />number of bedrooms, however more than five bedrooms , will require a <br />denitrification unit. <br />The plans depict a three bedroom dwelling and if any changes are made will <br />require approval by the Zoning Enforcement Officer. <br />Ron Bonvie made a motion to approve and issue a special permit to Rachel M. & <br />Errol W. Hicks, Trustees under §174-20 of the Zoning By-laws concerning <br />rebuilding of destroyed or damaged non -conforming structures to allow for <br />rebuilding of a single-family dwelling on property located in an R-3 Zoning <br />District at 47 Orchard Road (Map 62 Parcel 3), Mashpee, MA. <br />This is made reference to the proposed sewage disposal system, prepared for <br />Rachel Hicks, House Number 47 Orchard Road, Mashpee, Mass. dated March 28, <br />2013, File No. 158MA, scale as noted, prepared by Cape & Island Engineering, <br />14,500 square feet. <br />Mr. Blaisdell seconded the motion. Votes: Mr. Furbush, yes, Mr. Reiffarth; yes, <br />Ms. Horton, yes, Mr. Dorsey, yes, Mr. DeBarros, yes. All were in favor. <br />Judy Horton made a motion to approve the March 27, 2013 Meeting Minutes. <br />Votes: Mr. Furbush, yes, Mr. Blaisdell, yes, Mr. Bonvie, yes, Mr. Reiffarth, yes, <br />Mr. Dorsey yes, Mr. DeBarros, yes.
