Bacon ("Bacon") alleges as follows: <br /> NATURE OF CLAIMS <br /> 1. This is an appeal seeking to annul the decisions of the Town of Mashpee Zoning Board of <br /> Appeals (the "Board of Appeals") granting defendants Joseph P. Gennaco and Jean E. <br /> Gennaco (the "Genaccos")two Special Permits/Written Findings pursuant to Sections 174- <br /> 17 and 174-20 of the Town of Mashpee Zoning Bylaws (the"Bylaws" or"Bylaw") for the <br /> reconstruction of a single-family dwelling at 46 Kim Path in Mashpee(the"Genacco <br /> Property" or the "Project"). Bacon asserts that the decision of the Board of Appeals granting <br /> the Special Permits/Written Findings is legally untenable or is unreasonable, whimsical, <br /> capricious and arbitrary. <br />
