THE PARTIES <br /> 2. Bacon resides atl 1 Michael Road, Hingham, Massachusetts. Bacon is the Executor of the <br /> Estate for his late mother, Janice L. Bacon. The Estate of Janice L. Bacon owns the property <br /> located at 42 Kim Path, Mashpee, Massachusetts (the"Bacon Property"). The Bacon <br /> Property abuts the Gennaco Property. Bacon is a person aggrieved by the decision of the <br /> Board of Appeals and is affected thereby. <br /> 3. The Board of Appeals is the permit granting authority of the Town of Mashpee (the "Town"), <br /> with a principal place of business at Mashpee Town Hall, 16 Great Neck Road, Mashpee, <br /> Massachusetts. On July 3, 2013, it caused to be filed with the Town Clerk of the Town the <br /> decision from which Bacon appeals. <br /> 4. On information and belief, the Board of Appeals consists of Jonathan D. Furbush, William A. <br /> Blaisdell, Ronald S. Bonvie, Richard J. Jodka and John M. Dorsey. <br /> 5. On information and belief, the Gennacos reside at 46 Kim Path, Mashpee, Massachusetts. <br /> On information and belief,the Gennacos own the Gennaco Property. <br /> BACKGROUND FACTS <br /> 6. The Property contains approximately 7,125 square feet and is located within the R-3 zoning <br /> district and the Popponesset Overlay zoning district. <br /> 7. On information and belief,there is an existing 1'/z story single-family dwelling and shed on <br /> the Gennaco Property. On information and belief, the existing dwelling has not been <br /> destroyed or damaged by fire, flood, lightning,wind or otherwise. On information and <br /> belief, the existing dwelling does not conform to the required 15 foot side yard setback on the <br /> property line abutting the Bacon Property and is nonconforming. <br /> 2 <br />
