8. On information and belief, on or about May 14, 2013, the Gennaco submitted a petition to <br /> the Board of Appeals seeking two Special Permits/Written Findings under Sections 174-17 <br /> and 174-20 of the Bylaws to reconstruct the existing nonconforming dwelling on the <br /> Gennaco Property. On information and belief,the Gennacos propose to expand the structure <br /> along the nonconforming sideyard setback and increase the height of the structure so that it <br /> will have at least two full stories. Additionally, on information and belief, the Gennacos <br /> propose to remove the existing shed on the Gennaco Property and use the lot coverage area <br /> of the shed to expand the livable area of the dwelling while maintaining no net increase in lot <br /> coverage. <br /> 9. On information and belief, June 12, 2013,the Board of Appeals conducted a public hearing <br /> on the petition. <br /> 10. At the public hearing, Bacon presented written concerns requesting that the proposed <br /> dwelling be setback further back from Kim Path so that the front yard would be consistent <br /> with the other front yards and"streetscape" of the neighborhood. The neighborhood consists <br /> of small, 1'/2 story houses on small lot and is dense. The construction of the proposed <br /> dwelling closer to Kim Path and higher than the other dwellings in the neighborhood <br /> increases the density along Kim Path and is substantially detrimental to the neighborhood. <br /> The dwelling could be set back further from Kim Path while also conforming to the front and <br /> rear yard setbacks. <br /> 11. The relocation of the proposed dwelling further back from Kim Path would also minimize the <br /> adverse effects of the expansion of the proposed dwelling along the nonconforming side yard <br /> setback. The expansion of the proposed dwelling along the nonconforming side yard <br /> setback will intensify the use of the Gennaco property along the nonconforming side yard <br /> 3 <br />
