MASHPEE ZONING BOARD OF APPEALS <br />JUNE 12, 2013 <br />• MINUTES <br />In addition, a new Title 5 septic system will be installed. The existing system is a sub -surface <br />system and is not a cesspool like in many of the dwellings in the area. Mr. Kirrane stated that <br />Mr. Tim Luff, Architect was present and designed the proposed structure is available to <br />answer any questions. He stated the Board must find the proposed alternation or extension <br />will not be substantially more detrimental than what currently exists and adequate land area to <br />provide sufficient parking and setbacks as maybe required. <br />Mr. Kirrane stated the setback is not a massive change on the Northwesterly side, and <br />improving not increasing the lot coverage, installing a more up-to-date septic system and <br />building a home that will conform to current day building code requirements. A poured <br />foundation and will improve the conditions of the premise and will add significant value to <br />what is there now and will have a positive impact on the neighboring properties. The frontage <br />will be 25.7 feet, and the requirement is 25 feet and meets the requirements. <br />Mr. Furbush asked Tim Luff if there will be dry wells off the roof. Tim stated a small section <br />is in the flood zone that connects slightly on the Southeasterly portion of the building and <br />therefore that constituted a filing with Conservation and was approved. <br />Mr. Furbush asked Tim what the front wall was for between the proposed house and the <br />street. Tim mentioned the grades on the property are at elevation 12 and to lower elevation 8, <br />• so there's a 4 foot grade change. The objective of the wall is to keep a level grade of the steps <br />and porch across the front. <br />Mr. Furbush asked Tim if the septic is on the inside of the wall. Tim stated the soil absorption <br />system is in the flood zone. Mr. Bonvie read the memo dated June 11, 2013; "To the Board of <br />Appeals, from Veronica Warden, Assistant Health Agent, of the Board of Health, Joseph P. . <br />and Jean E. Gennaco (46 Kim Path), - In Zone II. Site and Design plans for the leaching <br />facility have not been formally submitted to the Board of Health." <br />Mr. Luff stated he does not believe a variance is required for this septic system. He stated the <br />elevation of the septic system will be higher than the home at the end of the street and was <br />designed by a registered professional engineer and is a legally approved Title 5 septic system <br />designed specifically for this property. He stated the average grade is elevation 11 and the <br />highest point of the building is 29 feet. He stated if he is forced to redo the septic plans, then <br />the design of the house and the roof line will have to change. <br />Mr. Morgan stated that a Board of Health approved septic system plans should be in place <br />prior to the Zoning Board accepting the proposed house plans. Mr. Furbush and the other <br />Board members were surprised that BSS Design had not submitted their plans for the septic <br />system. Mr. Morgan stated that when a project is presented, it shows the septic system, and <br />shows the roof run-offs. <br />Mr. Kirrane stated that BSS design and engineers should have spoken with the Conservation <br />• Commission and gave the plans to the Board of Health. <br />a <br />
