MASHPEE ZONING BOARD OF APPEALS <br />JUNE 12, 2013 <br />MINUTES <br />Mr. Chuck Bacon, an abutter residing at 42 Kim Path introduced himself. He would like the <br />streetscape to stay the same and be consistent with the current average setbacks as the homes <br />along Shore Drive. <br />Mr. Forbush stated that the Zoning Board cannot force the homeowner to move the house <br />back. The homeowners are not looking for a variance and have every right to put the house <br />where they are proposing. He suggested the abutter talk with the architect and homeowner. If <br />a change is made to the plans then the Board must be notified. Mr. Luff stated he cannot speak <br />for the owner; however, he did speak with him briefly and did mention the proximity distance <br />from the setback. He said he marked the setback at 25.7 off the lot line and asked if he <br />consider pushing it back a little more. <br />Mr. Bonvie made a motion requesting to continue to the hearing date of June 26, 2013 for <br />Joseph P. and Jean E. Gennaco's request for a Written Finding under § 174-17 of the Zoning <br />By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration of a pre- <br />existing, non -conforming structurc to raze and replace a dwelling located on property in an R- <br />3 Zoning District at 46 Kim Path (Map 117 Parcel 94) Mashpee, MA. Also continue Joseph P. <br />and Jean E. Gennaco's request a Written Finding under §174-20 of the Zoning By-laws <br />concerning rebuilding of destroyed or damaged non -conforming structures to allow for <br />rebuilding of a single-family dwelling on property located in an R-3 Zoning District at 46 Kim <br />Path (Map 117 Parcel 94). <br />is <br />Mr. Reiffarth seconded the motion to continue, Mr. Forbush, yes, Mr. Blaisdell, yes, Mr. <br />Dorsey, yes, Mr. DeBarros, yes, Mr. Jodka, yes. Mantel & Lewis Mantel request for Special <br />Permit under 4174-25.I.9 at 270 Monomoscov Road (Map 120, Parcel 58), Mashpee, MA <br />Mr. Blaisdell made a motion to accept the extension submitted by Jeanne S. Mantel and Lewis <br />Mantel request for special permit under §174-25.I.9 at 270 Monomoscoy Road (Map 120, <br />Parcel 58), Mashpee, MA. Mr. Dorsey seconded and accepted the extension, yes, Mr. <br />Forbush, yes, Mr. DeBarros, yes.
