MASHPEE ZONING BOARD OF APPEALS <br />AUGUST 14, 2013 <br />MINUTES <br />Jeanne S. Mantel & Lewis Mantel, Trustees: Request a Special Permit under §174- <br />25.H (7) of the Zoning By-laws to allow for construction of a dock where the lot cannot <br />be developed with a principle residential use, provided there be no commercial use or <br />storage, no sanitary facilities, no storage outside of buildings, no structure exceed fifteen <br />(15) feet in height and meet the applicable setback and lot coverage requirements on <br />property located in an R-3 Zoning District at 270 Monomoscoy Road (Map 120, Parcel <br />58), Mashpee, MA. <br />John Slavinsky stated he wanted to continue this hearing because he does not have <br />accurate plans. He stated the walkway exceeds 70 feet and the plans need to be revised. <br />Jon Furbush read the comments from Andrew McManus, Conservation Department, <br />dated June 10, 2013. "The Conservation Commission voted to approve the proposed <br />dock/pier/float and parking area at 270 Monomoscoy Rd. The commission had concerns <br />regarding the setback/extent of proposed clearing for the parking lot to the delineated line <br />of bordering vegetated wetland (entire lot is within 50' of the bordering vegetated <br />wetland). The project proponents agreed to move the parking area back (landward) by 10 <br />feet, thus reducing the overall footprint of disturbance. The dock/pier/float and revised <br />parking area were approved at our May 9, 2013 hearing. As per our Chapter 172 Wetland <br />by-law, the pathway to the dock shall be no wider than 4' nor shall the pier be wider than <br />• 4' along its entire length, with the exception of the float. The property address and DEP <br />permit # must be displayed IN PERPETUITY on the following locations once the dock <br />construction is complete:" <br />1. The most seaward facing dock piling <br />2. The float <br />3. The ramp <br />• <br />Also read into the record was the Harbormaster, dated August 3, 2013. <br />"Lettering can be hand painted or stenciled and must be a minimum of 3" in height, so <br />this required signage can be visible from the water. The DEP permit # must also be <br />displayed prominently from the road." The Harbormaster, Plan dated March 20, 2013, <br />Pier must be shortened by 20'. <br />Also required, the street address must be permanently and clearly displayed with <br />minimum of 3" block letters with contrasting color at end of pier/piling for emergency <br />purposes, and in addition to the owners address be permanently affixed on all floats and <br />ramps with 3" block letters with contrasting color." signed, Stephen Mone, Harbormaster. <br />Jon read into the record, an email from Stephen Mone, Harbormaster, dated Tuesday, <br />August 13, 2013. "The float on the plan has.two sides, 25 feet long, that configuration <br />would hold two boats unless they plan on tying to the fixed pier, I think it would be the <br />maximum potentially. Please see my comment below, that I believe were not addressed <br />shortening the pier by 20 feet". <br />7 <br />
