MASHPEE ZONING BOARD OF APPEALS
AUGUST 14, 2013
• MINUTES
Richard Jodka read a letter submitted by Catherine Laurent, Director regarding the
subject petition: "I have reviewed the application and plans for the Special Permit request
for the above property. The application proposes the construction of a dock on a separate
lot with a float to accommodate three boats. A small gravel parking area is proposed.
If the Special Permit is approved, I recommend that conditions be imposed requiring that
the parking area be designed in accordance with the dimensional requirements of the
Zoning Bylaw, with a minimum of three spaces and a turnaround, and that parking on
Monomoscoy Road be prohibited. For your and the applicants information, Curb Cut
Permit from the DPW would also be required."
Ron Bonvie stated if the Board approves this application the lot would become
unbuildable. If the Board of Health changed and a mounting system is now approved, you
will still have an unbuildable lot. The applicant needs to clearly understand the Bylaws.
John Slavinsky addressed the Board and decided to withdraw this petition.
Patrick Foley, and abutter approached the Board and resides at 276 Monomoscoy Road.
He asked wanted to know if the hearing will be rescheduled for another time. He stated
he is in full opposition.
Julie Brady approached the Board and stated she resides at -256 Monomoscoy Road, and
is concerned that she will be not be able to attend if the applicant reapplies during the
Winter.
The Board signed the withdrawal form at the request of the petitioner.
Informal Discussion with Mashpee Commons
Tom Feronti announced he would like to discuss the construction of Market Street
instead of the four foundations as a condition of the permit. He would like to know if
Mashpee Commons can formally apply and change the language, not a complete
alteration, but adding a clause that allows the swap of Market Street at their discretion for
the four foundations. The final letter of approval needs to be completed for Mass Housing
Authority by April 2, 2014, but if the four foundations need to be constructed it can fast-
track the process forward a few months in time to pull permits to build the four
foundations.
Jon Furbush stated he consulted with Town Counsel on August 9, 2013 and Market Street
cannot be "swapped" with the four foundations.
Tom stated he is meeting with Katy Lacy from Mass Housing and are on target. All the
pieces of the final letter of approval required to solve the issue of the four foundations
• needs to be expedited such as securing financing, architectural, and engineering to
advance the work and install the four foundations by April 2, 2014.
