MASHPEE ZONING BOARD OF APPEALS <br />AUGUST 14, 2013 <br />• MINUTES <br />Richard Jodka read a letter submitted by Catherine Laurent, Director regarding the <br />subject petition: "I have reviewed the application and plans for the Special Permit request <br />for the above property. The application proposes the construction of a dock on a separate <br />lot with a float to accommodate three boats. A small gravel parking area is proposed. <br />If the Special Permit is approved, I recommend that conditions be imposed requiring that <br />the parking area be designed in accordance with the dimensional requirements of the <br />Zoning Bylaw, with a minimum of three spaces and a turnaround, and that parking on <br />Monomoscoy Road be prohibited. For your and the applicants information, Curb Cut <br />Permit from the DPW would also be required." <br />Ron Bonvie stated if the Board approves this application the lot would become <br />unbuildable. If the Board of Health changed and a mounting system is now approved, you <br />will still have an unbuildable lot. The applicant needs to clearly understand the Bylaws. <br />John Slavinsky addressed the Board and decided to withdraw this petition. <br />Patrick Foley, and abutter approached the Board and resides at 276 Monomoscoy Road. <br />He asked wanted to know if the hearing will be rescheduled for another time. He stated <br />he is in full opposition. <br />Julie Brady approached the Board and stated she resides at -256 Monomoscoy Road, and <br />is concerned that she will be not be able to attend if the applicant reapplies during the <br />Winter. <br />The Board signed the withdrawal form at the request of the petitioner. <br />Informal Discussion with Mashpee Commons <br />Tom Feronti announced he would like to discuss the construction of Market Street <br />instead of the four foundations as a condition of the permit. He would like to know if <br />Mashpee Commons can formally apply and change the language, not a complete <br />alteration, but adding a clause that allows the swap of Market Street at their discretion for <br />the four foundations. The final letter of approval needs to be completed for Mass Housing <br />Authority by April 2, 2014, but if the four foundations need to be constructed it can fast- <br />track the process forward a few months in time to pull permits to build the four <br />foundations. <br />Jon Furbush stated he consulted with Town Counsel on August 9, 2013 and Market Street <br />cannot be "swapped" with the four foundations. <br />Tom stated he is meeting with Katy Lacy from Mass Housing and are on target. All the <br />pieces of the final letter of approval required to solve the issue of the four foundations <br />• needs to be expedited such as securing financing, architectural, and engineering to <br />advance the work and install the four foundations by April 2, 2014. <br />
