All were in favor. <br />Beverly Ormston: Requests a Written Finding under §174-17 of the Zoning By-laws <br />and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration of a pre- <br />existing, non -conforming structure to allow for construction of an addition on property <br />located in an R-3 Zoning District at 148 Whippoorwill Circle (Map 125 Parcel 143), <br />Mashpee, MA. <br />Michael Borselli, Falmouth Engineering representing the applicant Beverly Ormston. <br />This property is located in a fully developed subdivision of single-family dwellings. He <br />stated he is applying for a written finding of a small addition because it is a pre-existing <br />non -conforming structure. <br />The house is pre-existing non -conforming in two places. The minimum front yard zoning <br />setback is 40 feet, and the closest point on the existing home is 39 feet. There is a <br />minimum setback of 15 feet from the rear or side line setback and on the existing deck on <br />the West which is part of the structure is under 12 feet. These are the pre-existing non- <br />conforming setbacks. <br />The applicant is proposing to add onto the North Eastern comer of the house, measuring <br />14 feet by 6 feet and is sized by design to meet the minimum setbacks. The setback from <br />the side is 15.5 feet and setback from the front yard will be 40.5 feet. The current lot <br />coverage is 14.1 % below the maximum allowed. If approved, the construction of the lot <br />coverage increases to 15.9% which is well below the maximum allowed. There is <br />currently three bedrooms and will be three bedrooms after the renovation. The addition is <br />an interior master bedroom renovation and a larger bathroom for wheelchair access and <br />expanded closest. There is no substantial changes on the property and is not more <br />detrimental to the neighborhood. The home is a ranch style home and the ridge of the <br />addition will be the same height as the existing house. <br />The Board of Health comment dated August 13, 2013 states= "Not in Zone II. Should the <br />Board vote favorably for the requested relief, please inform the applicant a septic <br />inspection will be required prior to building permit sign -off." <br />Ron Bonvie made a motion to approve the Written Finding under § 174-17, of the Zoning <br />By-laws and M.G.L.
