MASHPEE ZONING BOARD OF APPEALS <br />AUGUST 14, 2013 <br />MINUTES <br />The motion is contingent upon the Board of Health memorandum- "Not in Zone I1 <br />Should the Board vote favorably for the requested relief, please inform the applicant a <br />septic inspection will be required prior to building permit sign -off." Also, reference the <br />following plot plans for 148 Whippoorwhill Circle, prepared by Falmouth Engineering <br />for Beverly Ormston, dated June 18, 2013, Plan Scale: 1'= 20', Project Number: 13046, <br />CAD file Name: 13046SP, Drawn by: L.M., sheet 1 of 1. Also house elevation plans, <br />prepared by P.L.A.N.S. Company, 508-397-117, dated June 27, 2013 consisting of four <br />pages. <br />The Board finds the proposal is not substantially more detrimental than the pre-existing <br />non -conform structure. The new addition will be an improvement and will conform to <br />current building code requirements and is compatible in size and character to other <br />structures in the neighborhood and issuing the finding that there is sufficient parking and <br />setbacks as may be required. <br />Jon Furbush second the motion, yes. Votes: Bill Blaisdell, yes, Jim Reiffarth, yes, Dom <br />DeBarros, yes, and Richard Jodka, yes. All were in favor. <br />Petitioner: Peter Michaelson: Request a Written Finding under §174-17 of the Zoning <br />By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or alteration of a <br />pre-existing, non -conforming structure to allow for construction of a new single-family <br />dwelling on property located in an R-3 Zoning District at 24 Shipwreck Drive, (Map 76 <br />Parcel 56), Mashpee, MA. (Owner of record: Francis E. DeMaio) <br />Steve Cook, of Cotuit Bay Design and also present is Peter Michaelson the petitioner. <br />Mr. Michaelson purchased the home from Francis E. DeMaio. He received a phone call <br />stating there was a miscommunication and the application needs to be withdrawn. <br />Chairman, Jon Furbush apologized for the error and there will be no additional charge to <br />the applicant. <br />Ron Bonvie made a motion to accept a withdrawal without prejudice from the petitioner <br />Peter Michaelson under §174-17 of the Zoning Bylaws and M.G.L. Chapter 40A §6 <br />concerning continuance, extension or alteration of a pre-existing, non -conforming <br />structure to allow for construction of a new single-family dwelling on property located in <br />an R-3 Zoning District at 24 Shipwreck Drive, (Map 76 Parcel 56), Mashpee, MA. <br />Owner of record: Francis E. All <br />were in favor. <br />Steve Cook asked the Board for permission to discuss the project as an informal <br />discussion. Mr. Furbush and the Board members agreed to accept an informational <br />discussion with Steve Cook regarding the proposal. <br />5 <br />
