MASHPEE ZONING BOARD OF APPEALS <br />SEPTEMBER 11, 2013 <br />• MINUTES <br />Prior to any construction, the applicant applies to the Board of Health and obtains all <br />necessary permits from the various Boards and Committees and references the proposed <br />site plan located in Mashpee, MA prepared for The Mary Anne McGonagle Nominee Trust, <br />date: August 1, 2013, scale: 1" = 20, file: 147MA, pimpnd104, prepared by Cape & Islands <br />Engineering, 800 Falmouth Road, Suite 301 C, Mashpee, MA 02649. Variance required = <br />7,300 square feet. <br />Bill Blaisdell, second, yes, Votes: Jim Reiffarth, yes, Richard Jodka, yes, and Dom <br />DeBarros, yes; All were in favor. <br />NEW HEARINGS <br />Paul and Patricia Colella: Request a Written Finding under Article V §174-17 of the <br />Zoning By-laws and M.G.L. Chapter 40A §6 concerning continuance, extension or <br />alteration of a pre-existing, non -conforming structure to raze and replace a dwelling on <br />property located in an R-3 Zoning District at 15 Bayview Road and 20 Riverside Road <br />(Map 119 Parcels 114 and 116) Mashpee, MA. <br />Paul and Patricia Colella: Request a Written Finding under Article V §174-20 of the <br />Zoning By-laws concerning rebuilding of destroyed or damaged non -conforming <br />structures to allow for rebuilding of a single-family dwelling on property located in an R- <br />• 3 Zoning District at 15 Bayview Road and 20 Riverside Road (Map 119 Parcels 114 and <br />116) Mashpee, MA. <br />Mr. Colella presented his petition to the Board stating he purchased the first parcel in 1968 <br />which was 50 feet wide and approximately 242 feet deep which primarily runs between <br />Riverside Road and Bayview Road. In 1981, he purchased the adjacent lot consisting of <br />100 square feet. He is requesting to raze and replace the cottage facing Bayview with a <br />new home approximately 3,000 square feet without a garage. The plan shows 36,070 <br />square feet total for both lots. <br />The original plan dated July 29, 2013 shows both lots stamped and drawn by Holmes and <br />McGrath, Inc. The Board requested a revised plan only showing the lot of the dwelling <br />being razed and replaced on Bayview. <br />Richard Jodka wanted to know the percentage of the Bayview Road lot that would consist <br />of the 3,000 square foot home. <br />Bill Blaisdell wanted to know the lot coverage for all the structures on a plan showing the <br />total 36,070 square feet stamped by certified engineers and showing prior design and after <br />design. The plans needs to show the 20% lot coverage. <br />The Board was concerned that the lots would be sold but according to the By-laws there <br />is <br />would have to be a condominium agreement and Mr. Colella stated he has no intensions of <br />selling. <br />
